धारा 50 एनडीपीएस एक्ट — वे शर्तें जिनके अधीन व्यक्तियों की तलाशी ली जाएगी –
(1) जब धारा 42 के अधीन सम्यक् रूप से प्राधिकृत कोई अधिकारी, धारा 41, धारा 42 या धारा 43 के उपबन्धों के अधीन किसी व्यक्ति की तलाशी लेने वाला है तब वह, ऐसे व्यक्ति को यदि ऐसा व्यक्ति ऐसी अपेक्षा करे तो, बिना अनावश्यक विलम्ब के धारा 42 में उल्लिखित किसी विभाग के निकटतम राजपत्रित अधिकारी या निकटतम मजिस्ट्रेट के पास ले जाएगा ।
(2) यदि ऐसी अपेक्षा की जाती है तो ऐसा अधिकारी ऐसे व्यक्ति को तब तक निरुद्ध रख सकेगा जब तक वह उसे उपधारा (1) में निर्दिष्ट राजपत्रित अधिकारी या मजिस्ट्रेट के समक्ष नहीं ले जा सकता ।
(3) यदि ऐसा राजपत्रित अधिकारी या मजिस्ट्रेट, जिसके समक्ष कोई ऐसा व्यक्ति लाया जाता है, तलाशी के लिए कोई उचित आधार नहीं पाता है तो वह ऐसे व्यक्ति को तत्काल उन्मोचित कर देगा किन्तु अन्यथा यह निदेश देगा कि तलाशी ली जाए ।
(4) किसी स्त्री की तलाशी, स्त्री से भिन्न किसी अन्य व्यक्ति द्वारा नहीं ली जाएगी ।
(5) जब धारा 42 के अधीन सम्यक् रूप से प्राधिकृत किसी अधिकारी के पास यह विश्वास करने का कारण है कि उस व्यक्ति को जिसकी तलाशी ली जानी है, उसके कब्जे में की किसी स्वापक औषधि या मनःप्रभावी पदार्थ अथवा नियंत्रित पदार्थ या वस्तु या दस्तावेज को उस व्यक्ति से जिसकी तलाशी ली जानी है, अलग किए बिना निकटतम राजपत्रित अधिकारी या मजिस्ट्रेट के पास ले जाना संभव नहीं है, तो वह ऐसे व्यक्ति को निकटतम राजपत्रित अधिकारी या मजिस्ट्रेट के पास ले जाने की बजाय उस व्यक्ति की तलाशी ले सकेगा जैसा कि दंड प्रक्रिया संहिता, 1973 (1974 का 2) की धारा 100 में उपबंधित है ।
(6) उपधारा (5) के अधीन तलाशी लिए जाने के पश्चात् उक्त अधिकारी ऐसे विश्वास के कारणों को लेखबद्ध करेगा, जिसकी वजह से ऐसी तलाशी की आवश्यकता पड़ी थी और उसकी एक प्रति अपने अव्यवहित वरिष्ठ पदधारी को बहत्तर घंटे के भीतर भेजेगा ।
Section 50 NDPS Act — Conditions under which search of persons shall be conducted —
(1) When any officer duly authorised under section 42 is about to search any person under the provisions of section 41, section 42 or section 43, he shall, if such person so requires, take such person without unnecessary delay to nearest Gazetted Officer of any of the departments mentioned in section 42 or to the nearest Magistrate. धारा 50 एनडीपीएस एक्ट
(2) If such requisition is made, the officer may detain the person until he can bring him before the Gazetted Officer or the Magistrate referred to in sub-section (1).
(3) The Gazetted Officer or the Magistrate before whom any such person is brought shall, if he sees no reasonable ground for search, forthwith discharge the person but otherwise shall direct that search be made. धारा 50 एनडीपीएस एक्ट
(4) No female shall be searched by anyone excepting a female.
1[(5) When an officer duly authorised under section 42 has reason to believe that it is not possible to take the person to be searched to the nearest Gazetted Officer or Magistrate without the possibility of the person to be searched parting with possession of any narcotic drug or psychotropic substance, or controlled substance or article or document, he may, instead of taking such person to the nearest Gazetted Officer or Magistrate, proceed to search the person as provided under section100 of the Code of Criminal Procedure, 1973 (2 of 1974). धारा 50 एनडीपीएस एक्ट
(6) After a search is conducted under sub-section (5), the officer shall record the reasons for such belief which necessitated such search and within seventy-two hours send a copy thereof to his immediate official superior
