धारा 17 यूएपीए एक्ट – आतंकवादी कार्य के लिए निधियां जुटाने के लिए दंड-
जो कोई भारत में या विदेश में, प्रत्यक्ष रूप से या अप्रत्यक्ष रूप से, किसी व्यक्ति या किन्हीं व्यक्तियों से, चाहे किसी विधिसम्मत या विधिविरुद्ध स्रोत से, निधियां जुटाता है या उपलब्ध कराता है या निधियां संगृहीत करता है या उपलब्ध कराने का प्रयास करता है अथवा यह जानते हुए कि ऐसी निधियों का ऐसे व्यक्ति या व्यक्तियों द्वारा या किसी आतंकवादी संगठन द्वारा या किसी आतंकवादी गैंग द्वारा या किसी व्यष्टि आतंकवादी द्वारा कोई आतंकवादी कार्य करने के लिए, पूर्णतः या भागतः उपयोग किए जाने की संभावना है, किसी व्यक्ति या किन्हीं व्यक्तियों के लिए, इस बात को विचार में लिए बिना कि ऐसी निधियों का ऐसे कार्य को करने के लिए वस्तुतः प्रयोग किया गया था अथवा नहीं, निधियां जुटाता है या संगृहीत करता है, वह ऐसी अवधि के कारावास से, जो पांच वर्ष से कम की नहीं होगी, किंतु जो आजीवन कारावास तक की हो सकेगी, दंडनीय होगा और जुर्माने के लिए भी दायी होगा ।
स्पष्टीकरण- इस धारा के प्रयोजन के लिए, –
(क) इसमें वर्णित किसी भी कार्य में भाग लेने, संगठित होने या उसका संचालन करने से अपराध गठित होगा;
(ख) निधियां जुटाने के अंतर्गत उच्च क्वालिटी की कूटकृत भारतीय करेंसी के निर्माण या उसकी तस्करी या परिचालन के माध्यम से निधियां जुटाना या संगृहीत करना या उपलब्ध कराना भी है;
(ग) ऐसे प्रयोजन के लिए, जो विनिर्दिष्टतया धारा 15 के अधीन नहीं आता है, किसी व्यष्टि आतंकवादी, आतंकवादी गैंग या आतंकवादी संगठन के फायदे के लिए या किसी रीति में निधि जुटाने या संगृहीत करने या उसको उपलब्ध कराने को भी अपराध समझा जाएगा ।
Section 17 UAPA Act – 1, 2[ Punishment for raising funds for terrorist act.–
Whoever, in India or in a foreign country, directly or indirectly, raises or provides funds or collects funds, whether from a legitimate or illegitimate source, from any person or persons or attempts to provide to, or raises or collects funds for any person or persons, knowing that such funds are likely to be used, in full or in part by such person or persons or by a terrorist organisation or by a terrorist gang or by an individual terrorist to commit a terrorist act, notwithstanding whether such funds were actually used or not for commission of such act, shall be punishable with imprisonment for a term which shall not be less than five years but which may extend to imprisonment for life, and shall also be liable to fine. धारा 17 यूएपीए एक्ट
Explanation.–For the purpose of this section,
(a) participating, organising or directing in any of the acts stated therein shall constitute an offence; धारा 17 यूएपीए एक्ट
(b) raising funds shall include raising or collecting or providing funds through production or smuggling or circulation of high quality counterfeit Indian currency; and
