धारा 43 यूएपीए एक्ट — अध्याय 4 और अध्याय 6 अधीन अपराधों का अन्वेषण करने के लिए सक्षम प्राधिकारी-
संहिता में अंतर्विष्ट किसी बात के होते हुए भी, ऐसा कोई पुलिस अधिकारी, जो,-
(क) दिल्ली विशेष पुलिस स्थापन अधिनियम, 1946 (1946 का 25) की धारा 2 की उपधारा (1) के अधीन गठित दिल्ली विशेष पुलिस स्थापन की दशा में, पुलिस उपायुक्त की पंक्ति से नीचे का या समतुल्य पंक्ति का पुलिस अधिकारी है;
(ख) मुम्बई, कोलकाता, चैन्नई और अहमदाबाद के महानगर क्षेत्रों में और संहिता की धारा 8 की उपधारा (1) के अधीन उस रूप में अधिसूचित किसी अन्य महानगर क्षेत्र में, सहायक पुलिस आयुक्त की पंक्ति से नीचे का है;
(खक) राष्ट्रीय अन्वेषण अभिकरण की दशा में ,निरीक्षक की पंक्ति से नीचे का है;
(ग) किसी भी दशा में, जो खंड (क) या खंड (ख) या खंड (खक) से संबंधित नहीं है, पुलिस उप अधीक्षक से नीचे का या समतुल्य पंक्ति का पुलिस अधिकारी है, अध्याय 4 और अध्याय 6 के अधीन दंडनीय किसी अपराध का अन्वेषण नहीं करेगा ।
Section 43 UAPA Act — Officers competent to investigate offence under Chapters IV and VI-
Notwithstanding anything contained in the Code, no police officer,–
(a) in the case of the Delhi Special Police Establishment, constituted under sub-section (1) of section 2 of the Delhi Special Police Establishment Act, 1946 (25 of 1946), below the rank of a Deputy Superintendent of Police or a police officer of equivalent rank;
(b) in the metropolitan areas of Mumbai, Kolkata, Chennai and Ahmedabad and any other metropolitan area notified as such under sub-section (1) of section 8 of the Code, below the rank of an Assistant Commissioner of Police;
1[(ba) in the case of National Investigation Agency, below the rank of Inspector];
(c) in any case not relatable to clause (a) 1[or clause (ba)], below the rank of a Deputy Superintendent of Police or a police officer of an equivalent rank,
Shall investigate any offence punishable under Chapter IV or VI.
