संपत्ति अंतरण अधिनियम की धारा 78 – पूर्विक बंधकदार का मुल्तवी होना-
जहां कि किसी पूर्विक बन्धकदार के कपट, मिथ्या व्यपदेशन या घोर उपेक्षा से कोई अन्य व्यक्ति बन्धक-सम्पत्ति की प्रतिभूति पर धन उधार देने के लिए उत्प्रेरित हुआ है, वहां वह पूर्विक बन्धकदार उस पाश्चिक बन्धकदार के मुकाबले में मुल्तवी हो जाएगा।
Section 78 TPA – Postponement of prior mortgagee –
Where, through the fraud, misrepresentation or gross neglect of a prior mortgagee, another person has been induced to advance money on the security of the mortgaged property, the prior mortgagee shall be postponed to the subsequent mortgagee.
