धारा 10 यूएपीए एक्ट – किसी विधिविरुद्ध संगम, आदि का सदस्य हाने पर शास्ति-
जहां किसी संगम के धारा 3 के अधीन जारी की गई किसी अधिसूचना द्वारा, जो उस धारा की उपधारा (3) के अधीन प्रभावी हो गई है, विधिविरुद्ध घोषित किया जाता है, वहां,-
(क) कोई व्यक्ति जो,-
(i) ऐसे संगम का सदस्य है और बना रहता है ; या
(ii) ऐसे संगम के अधिवेशनों में भाग लेता है ; या
(iii) ऐसे संगम के प्रयोजन के लिए अभिदाय करता है या उसके लिए कोई अभिदाय प्राप्त करता है या उसकी इच्छा करता है ; या
(iv) किसी प्रकार ऐसे संगम की संक्रियाओं में सहायता करता है,
कारावास से, जिसकी अवधि दो वर्ष तक की हो सकेगी, दंडनीय होगा और जुर्माने का भी दायी होगा ; और
(ख) कोई व्यक्ति, जो ऐसे संगम का सदस्य है या बना रहता है या स्वेच्छया ऐसे संगम के उद्देश्यों में किसी रीति से सहायता करने के लिए या उनका संवर्धन करने के लिए कोई कार्य करता है और किसी भी दशा में कोई अननुज्ञप्त अग्न्यायुध, गोलाबारूद, विस्फोटक या अन्य उपस्कर अथवा पदार्थ, जो सामूहिक विनाश कारित करने में समर्थ हो, कब्जे में रखता है और कोई ऐसा कार्य करता है, जिसके परिणामस्वरूप मानव जीवन की हानि होती है या किसी व्यक्ति को गंभीर क्षति होती है या किसी संपत्ति को कोई महत्वपूर्ण नुकसान कारित करता है,-
(i) और यदि ऐसे कार्य के परिणामस्वरूप किसी व्यक्ति की मृत्यु हो जाती है, तो वह मृत्यु से या आजीवन कारावास से दंडनीय होगा और जुर्माने का भी दायी होगा;
(ii) किसी अन्य दशा में, ऐसी अवधि के कारावास से, जो पांच वर्ष से कम नहीं होगा, किंतु आजीवन कारावास हो सकेगा, दंडनीय होगा और जुर्माने का भी दायी होगा ।
Section 10 UAPA Act –1[Penalty for being member of an unlawful association, etc.—
Where an association is declared unlawful by a notification issued under section 3 which has become effective under sub-section (3) of that section,—
(a) a person, who—
(i) is and continues to be a member of such association; or
(ii) takes part in meetings of such association; or
(iii) contributes to, or receives or solicits any contribution for the purpose of, such association; or
(iv) in any way assists the operations of such association,
shall be punishable with imprisonment for a term which may extend to two years, and shall also be liable to fine; and धारा 10 यूएपीए एक्ट
(b) a person, who is or continues to be a member of such association, or voluntarily does an act aiding or promoting in any manner the objects of such association and in either case is in possession of any unlicensed firearms, ammunition, explosive or other instrument or substance capable of causing mass destruction and commits any act resulting in loss of human life or grievous injury to any person or causes significant damage to any property,—
(i) and if such act has resulted in the death of any person, shall be punishable with death or imprisonment for life, and shall also be liable to fine; धारा 10 यूएपीए एक्ट
(ii) in any other case, shall be punishable with imprisonment for a term which shall not be less than five years but which may extend to imprisonment for life, and shall also be liable to fine.]
