धारा 35 यूएपीए एक्ट — अनुसूची, आदि का संशोधन-
(1) केन्द्रीय सरकार, राजपत्र में अधिसूचना द्वारा-
(क) पहली अनुसूची में किसी संगठन को या चौथी अनुसूची में किसी व्यष्टि का नाम जोड़ सकेगी; या
(ख) अंतर्राष्ट्रीय आतंकवाद का सामना करने के लिए पहली अनुसूची में किसी ऐसे संगठन को जोड़ सकेगी, जिसके बारे में यह पता चलता है कि वह संयुक्त राष्ट्र के चार्टर के अध्याय 7 के अधीन सुरक्षा परिषद् द्वारा अंगीकृत संकल्प में आतंकवादी संगठन है या चौथी अनुसूची में किसी व्यष्टि का नाम जोड़ सकेगी; या
(ग) पहली अनुसूची से किसी संगठन को या चौथी अनुसूची में किसी व्यष्टि का नाम हटा सकेगी; या
(घ) पहली अनुसूची या चौथी अनुसूची का किसी अन्य रूप में संशोधन कर सकेगी ।
(2) केन्द्रीय सरकार किसी संगठन या किसी व्यष्टि के संबंध में उपधारा (1) के खंड (क) के अधीन अपनी शक्ति का प्रयोग तभी कर सकेगी जब उसे यह विश्वास हो जाता है कि कोई संगठन या कोई व्यष्टि आतंकवाद में संलिप्त है ।
(3) उपधारा (2) के प्रयोजनों के लिए, किसी संगठन या किसी व्यष्टि को आतंकवाद में संलिप्त समझा जाएगा, यदि ऐसा संगठन या व्यष्टि, –
(क) आतंकवादी कार्य करता है या उसमें भाग लेता है;
(ख) आतंकवाद के लिए तैयारी करता है;
(ग) आतंकवाद में अभिवृद्धि करता है या उसे बढ़ावा देता है; या
(घ) अन्यथा आतंकवाद में संलिप्त है ।
(4) केंद्रीय सरकार, राजपत्र में अधिसूचना द्वारा, दूसरी अनुसूची या तीसरी अनुसूची में जोड़ सकेगी या उससे हटा सकेगी या उसमें संशोधन कर सकेगी और इस प्रकार, यथास्थिति, दूसरी अनुसूची या तीसरी अनुसूची तद्नुसार संशोधित की गई समझी जाएगी ।
(5) उपधारा (1) या उपधारा (4) के अधीन जारी की गई प्रत्येक अधिसूचना, उसके जारी किए जाने के पश्चात्, यथाशीघ्र, संसद् के समक्ष रखी जाएगी ।
Section 35 UAPA Act — Amendment of Schedule, etc.–
(1) The Central Government may, by 2[notification], in the Official Gazette,–
(a) add an organisation to the 3[First Schedule] 4[or the name of an individual in the Fourth Schedule];
(b) add also an organisation to the 3[First Schedule], which is identified as a terrorist organisation in a resolution adopted by the Security Council under Chapter VII of the Charter of the United Nations, 4[or the name of an individual in the Fourth Schedule], to combat international terrorism;
(c) remove an organisation from the 3[First Schedule] 4[or the name of an individual from the Fourth Schedule];
(d) amend the 3[First Schedule] 4[or the Fourth Schedule] in some other way.
(2) The Central Government shall exercise its power under clause (a) of sub-section (1) in respect of 5[an organisation or an individual only if it believes that such organisation or individual is] involved in terrorism.
(3) For the purposes of sub-section (2), 6[an organisation or an individual shall be deemed to be involved in terrorism if such organisation or individual]– धारा 35 यूएपीए एक्ट
(a) commits or participates in acts of terrorism, or
(b) prepares for terrorism, or
(c) promotes or encourages terrorism, or
(d) is otherwise involved in terrorism.
7[(4) The Central Government may, by notification in the Official Gazette, add to or remove or amend the Second Schedule or Third Schedule and thereupon the Second Schedule or the Third Schedule, as the case may be, shall be deemed to have been amended accordingly. धारा 35 यूएपीए एक्ट
(5) Every notification issued under sub-section (1) or sub-section (4) shall, as soon as may be after it is issued, be laid before Parliament.]
