धारा 36 यूएपीए एक्ट — किसी आतंकवादी संगठन या व्यष्टि को अधिसूचना से निकाला जाना-
(1) यथास्थिति किसी संगठन को पहली अनुसूची से या किसी व्यष्टि का नाम चौथी अनूसूची से हटाने के लिए धारा 25 की उपधारा (1) के खंड (ग) के अधीन अपनी शक्ति का प्रयोग करने के लिए कोई आवेदन केन्द्रीय सरकार को किया जा सकेगा ।
(2) कोई आवेदन, –
(क) संगठन द्वारा; या
(ख) संगठन को किसी आतंकवादी संगठनो के रूप में पहली अनुसूची में सम्मिलित किए जाने से प्रभावित किसी व्यक्ति द्वारा; या
(ग) चौथी अनुसूची में के रूप में किसी व्यक्ति का नाम सम्मिलित किए जाने से प्रभावित व्यक्ति द्वारा,
किया जा सकेगा|
(3) केन्द्रीय सरकार, इस धारा के अधीन किए गए किसी आवेदन को ग्रहण करने या उसके निपटारे की प्रक्रिया विहित करने के लिए नियम बना सकेगी ।
(4) जहां उपधारा (1) के अधीन कोई आवेदन नामंजूर कर दिया गया है वहां आवेदक, धारा 37 की उपधारा (1) के अधीन केन्द्रीय सरकार द्वारा गठित पुनर्विलोकन समिति को, आवेदक द्वारा ऐसी नामंजूरी के आदेश की प्राप्ति की तारीख से एक मास के भीतर, पुनर्विलोकन के लिए, आवेदन कर सकेगा ।
(5) पुनर्विलोकन समिति, पहली अनुसूची से किसी संगठन को या चौथी अनुसूची से किसी व्यष्टि के नाम को हटाने से इंकार के विरुद्ध पुनर्विलोकन के लिए आवेदन को मंजूर कर सकेगी, यदि उसका यह विचार है कि नामंजूर करने का विनिश्चय, जब उस पर न्यायिक पुनर्विलोकन के किसी आवेदन के संबंध में लागू सिद्धान्तों को ध्यान में रखकर विचार किया गया था, दोषपूर्ण था ।
(6) जहां पुनर्विलोकन समिति, किसी संगठन या किसी व्यष्टि द्वारा या उसके संबंध में उपधारा (5) के अधीन पुनर्विलोकन मंजूर करती है वहां उस आशय का कोई आदेश कर सकेगी ।
(7) जहां उपधारा (6) के अधीन कोई आदेश किया जाता है, वहां केन्द्रीय सरकार, उसके द्वारा आदेश की प्रति प्राप्त करने पर, यथासंभवशीघ्र, संगठन को पहली अनुसूची से या किसी व्यष्टि का नाम चौथी अनुसूची से हटाने का आदेश करेगी ।
Section 36 UAPA Act — Denotification of 1[terrorist organisation or individual].–
(1) An application may be made to the Central Government for the exercise of its power under clause (c) of sub-section (1) of section 35 to remove 2[an organisation from the First Schedule, or as the case may be, the name of an individual from the Fourth Schedule].
(2) An application under sub-section (1) may be made by–
(a) the organisation, or
(b) any person affected by inclusion of the organisation in the 3[First Schedule as a terrorist organisation, or].
4[(c) any person affected by inclusion of his name in the Fourth Schedule as a terrorist.]
(3) The Central Government may prescribe the procedure for admission and disposal of an application made under this section. धारा 36 यूएपीए एक्ट
(4) Where an application under sub-section (1) has been rejected, the applicant may apply for a review to the Review Committee constituted by the Central Government under sub-section (1) of section 37 within one month from the date of receipt of the order of such refusal by the applicant. धारा 36 यूएपीए एक्ट
(5) The Review Committee may allow an application for review against rejection, to remove 5[an organisation from the First Schedule or the name of an individual from the Fourth Schedule], if it considers that the decision to reject was flawed when considered in the light of the principles applicable on an application for judicial review.
(6) Where the Review Committee allows review under sub-section (5) by or in respect of 6[or an individual], it may make an order to such effect. धारा 36 यूएपीए एक्ट
(7) Where an order is made under sub-section (6), the Central Government shall, as soon as the certified copy of the order is received by it, make an order removing the organisation from the 7[First Schedule or the name of an individual from the Fourth Schedule].
