धारा 38 यूएपीए एक्ट — किसी आतंकवादी संगठन की सदस्यता से संबंधित अपराध-
(1) कोई व्यक्ति, जो स्वयं को किसी आतंकवादी संगठन से सहबद्ध करता है या उसके क्रियाकलापों को अग्रसर करने के आशय से उसके साथ सहबद्ध होने की घोषणा करता है किसी आतंकवादी संगठन की सदस्यता से संबंधित कोई अपराध कारित करता है:
परन्तु यह उपधारा वहां लागू नहीं होगी, जहां आरोपित व्यक्ति यह साबित करने में समर्थ है कि,-
(क) संगठन को उस समय आतंकवादी संगठन के रूप में घोषित नहीं किया गया था, जब वह सदस्य बना था या उसने सदस्य बनने की घोषणा की थी; और
(ख) उसने, संगठन को आतंकवादी संगठन के रूप में पहली अनुसूची में सम्मिलित किए जाने के दौरान किसी भी समय उसके क्रियाकलापों में भाग नहीं लिया है ।
(2) कोई व्यक्ति, जो उपधारा (1) के अधीन किसी आतंकवादी संगठन की सदस्यता से संबंधित अपराध कारित करता है, ऐसे कारावास से, जिसकी अवधि दस वर्ष से अधिक नहीं हो सकेगी या जुर्माने से या दोनों से दंडनीय होगा ।
Section 38 UAPA Act — Offence relating to membership of a terrorist organisation–
(1) A person, who associates himself, or professes to be associated, with a terrorist organisation with intention to further its activities, commits an offence relating to membership of a terrorist organisation:
Provided that this sub-section shall not apply where the person charged is able to prove–
(a) that the organisation was not declared as a terrorist organisation at the time when he became a member or began to profess to be a member; and
(b) that he has not taken part in the activities of the organisation at any time during its inclusion in the 1[First Schedule] as a terrorist organisation.
(2) A person, who commits the offence relating to membership of a terrorist organisation under sub-section (1), shall be punishable with imprisonment for a term not exceeding ten years, or with fine, or with both.
