धारा 39 यूएपीए एक्ट — किसी आतंकवादी संगठन को दिए गए समर्थन से संबंधित अपराध-
(1) कोई व्यक्ति, किसी आतंकवादी संगठन को समर्थन दिए जाने से संबंधित अपराध करता है, –
(क) जो, आतंकवादी संगठन के क्रियाकलाप को अग्रसर करने के आशय से, –
(i) आतंकवादी संगठन के लिए समर्थन आमंत्रित करता है; और
(ii) ऐसा समर्थन, धारा 40 के अर्थान्तर्गत धन या अन्य संपत्ति की व्यवस्था करने के लिए नहीं है या उसी तक निर्बंधित नहीं है; या
(ख) जो, आतंकवादी संगठन के क्रियाकलाप को अग्रसर करने के आशय से, किसी ऐसी बैठक की व्यवस्था या प्रबंध करता है या बैठक की व्यवस्था या प्रबंध करने में सहायता करता है, जिसके बारे में वह यह जानता है कि वह, –
(i) आतंकवादी संगठन के समर्थन के लिए है; या
(ii) आतंकवादी संगठन के क्रियाकलाप को अग्रसर करने के लिए है; या
(iii) उसे ऐसे व्यक्ति द्वारा संबोधित किया जाना है, जो किसी आतंकवादी संगठन से सहबद्ध है या सहबद्ध होने की घोषणा करता है; या
(ग) जो, किसी आतंकवादी संगठन के क्रियाकलाप को अग्रसर करने के आशय से आतंकवादी संगठन के लिए समर्थन को प्रोत्साहित करने के प्रयोजन के लिए या उसके क्रियाकलाप को अग्रसर करने के लिए किसी बैठक को संबोधित करता है ।
(2) कोई व्यक्ति, जो उपधारा (1) के अधीन किसी आतंकवादी संगठन को दिए गए समर्थन से संबंधित अपराध करता है, ऐसे कारावास से, जिसकी अवधि दस वर्ष से अधिक नहीं होगी या जुर्माने से या दोनों से दंडनीय होगा ।
Section 39 UAPA Act — Offence relating to support given to a terrorist organisation.
(1) A person commits the offence relating to support given to a terrorist organisation,—
(a) who, with intention to further the activity of a terrorist organisation,—
(i) invites support for the terrorist organization; and
(ii) the support is not or is not restricted to provide money or other property within the meaning of section 40; or
(b) who, with intention to further the activity of a terrorist organisation, arranges, manages or assists in arranging or managing a meeting which he knows is—
(i) to support the terrorist organization; or
(ii) to further the activity of the terrorist organization; or
(iii) to be addressed by a person who associates or professes to be associated with the terrorist organisation; or
(c) who, with intention to further the activity of a terrorist organisation, addresses a meeting for the purpose of encouraging support for the terrorist organisation or to further its activity. धारा 39 यूएपीए एक्ट
(2) A person, who commits the offence relating to support given to a terrorist organisation under sub-section (1) shall be punishable with imprisonment for a term not exceeding ten years, or with fine, or with both.
