धारा 42 यूएपीए एक्ट — प्रत्यायोजन की शक्ति –
केन्द्रीय सरकार, राजपत्र में अधिसूचना द्वारा, यह निदेश दे सकेगी कि ऐसी सभी या किसी शक्ति का, जो धारा 7 या धारा 8 या दोनों धाराओं के अधीन उसके द्वारा प्रयोग की जाती है, ऐसी परिस्थितियों में और ऐसी दशाओं के अधीन यदि कोई है, जो अधिसूचना में विनिर्दिष्ट की जाए, राज्य सरकार द्वारा भी प्रयोग किया जाएगा और राज्य सरकार, केन्द्रीय सरकार के पूर्व अनुमोदन से, लिखित में आदेश द्वारा यह निदेश दे सकेगी कि ऐसी शक्ति का, जिसका उसके द्वारा प्रयोग किए जाने का निदेश दिया गया है, ऐसी परिस्थितियों में और ऐसी दशाओं के अधीन, यदि कोई है, जो निदेश में विनिर्दिष्ट की जाएं, राज्य सरकार के अधीनस्थ किसी व्यक्ति द्वारा, जो उसमें विनिर्दिष्ट हो, प्रयोग किया जा सकेगा ।
Section 42 UAPA Act — Power to delegate –
The Central Government may, by notification in the Official Gazette, direct that all or any of the powers which may be exercised by it under section 7, or section 8, or both, shall, in such circumstances and under such conditions, if any, as may be specified in the notification, be exercised also by any State Government and the State Government may, with the previous approval of the Central Government, by order in writing, direct that any power which has been directed to be exercised by it shall, in such circumstances and under such conditions, if any, as may be specified in the direction, be exercised by any person subordinate to the State Government as may be specified therein.
