धारा 49 भारतीय साक्ष्य अधिनियम – प्रथाओं, सिद्धान्तों आदि के बारे में रायें कब सुसंगत हैं —
जबकि न्यायालय को —
मनुष्यों के किसी निकाय या कुटुम्ब की प्रथाओं या सिद्धांतों के,
किसी धार्मिक या खैराती प्रतिष्ठान के संविधान और शासन के, अथवा
विशिष्ट जिले में या विशिष्ट वर्गों के लोगों द्वारा प्रयोग में लाए जाने वाले शब्दों या पदों के अर्थों के बारे में राय बनानी हो,
तब उनके संबंध में ज्ञान के विशेष साधन रखने वाले व्यक्तियों की रायें सुसंगत तथ्य हैं।
Section 49 Indian Evidence Act – Opinion as to usages, tenets, etc., when relevant —
When the Court has to form an opinion as to–
the usages and tenets of any body of men or family,
the constitution and government of any religious or charitable foundation, or
the meaning of words or terms used in particular districts or by particular classes of people,
the opinion of persons having special means of knowledge thereon are, relevant facts.
