धारा 68R एनडीपीएस एक्ट — सक्षम प्राधिकारी और अपील अधिकरण के पास सिविल न्यायालय की शक्तियां होना –
सक्षम प्राधिकारी और अपील अधिकरण को निम्नलिखित मामलों के बारे में, सिविल प्रक्रिया संहिता, 1908 (1908 का 5) के अधीन किसी वाद का विचारण करते समय, सिविल न्यायालय की सभी शक्तियां होंगी, अर्थात्: –
(क) किसी व्यक्ति को समन करना और उसको हाजिर कराना तथा शपथ पर उसकी परीक्षा करना;
(ख) दस्तावेजों के प्रकटीकरण तथा पेश किए जाने की अपेक्षा करना;
(ग) शपथ-पत्र पर साक्ष्य लेना;
(घ) किसी न्यायालय या कार्यालय से किसी लोक अभिलेख या उसकी प्रतिलिपि की अध्यपेक्षा करना;
(ङ) साक्षियों या दस्तावेजों की परीक्षा के लिए कमीशन निकालना;
(च) अन्य कोई विषय, जो विहित किया जाए ।
Section 68R NDPS Act — Competent authority and Appellate Tribunal to have powers of civil court.–
The competent authority and the Appellate Tribunal shall have all the powers of a civil court while trying a suit under the Code of Civil Procedure, 1908 (5 of 1908), in respect of the following matters, namely:–
(a) summoning and enforcing the attendance of any person and examining him on oath;
(b) requiring the discovery and production of documents;
(c) receiving evidence on affidavits;
(d) requisitioning any public record or copy thereof from any court or office;
(e) issuing commissions for examination of witnesses or documents;
(f) any other matter which may be prescribed.
