धारा 5 बाल-विवाह प्रतिषेध अधिनियम – बाल-विवाह से जन्मे बालकों का भरण-पोषण और अभिरक्षा-
(1) जहां बाल-विवाह से जन्मे बालक हैं, वहां जिला न्यायालय ऐसे बालकों की अभिरक्षा के लिए समुचित आदेश करेगा ।
(2) इस धारा के अधीन किसी बालक की अभिरक्षा के लिए कोई आदेश करते समय, बालक के कल्याण और सर्वोत्तम हितों पर जिला न्यायालय द्वारा, सर्वोपरि ध्यान दिया जाएगा ।
(3) बालक की अभिरक्षा के लिए किसी आदेश में, दूसरे पक्षकार की, ऐसे बालक तक ऐसी रीति से, जो बालक के हितों को सर्वोत्तम रूप से पूरा करती हो, पहुंच के लिए समुचित निदेश, और ऐसे अन्य आदेश, जो जिला न्यायालय बालक के हित में उचित समझे, सम्मिलित हो सकेंगे ।
(4) जिला न्यायालय विवाह के किसी पक्षकार या उनके माता-पिता या संरक्षक द्वारा बालक के भरण-पोषण का उपबंध करने के लिए समुचित आदेश भी कर सकेगा ।
5 Prohibition of Child Marriage Act – Custody and maintenance of children of child marriages-
(1) Where there are children born of the child marriage, the district court shall make an appropriate order for the custody of such children.
(2) While making an order for the custody of a child under this section, the welfare and best interests of the child shall be the paramount consideration to be given by the district court.
(3) An order for custody of a child may also include appropriate directions for giving to the other party access to the child in such a manner as may best serve the interests of the child, and such other orders as the district court may, in the interest of the child, deem proper.
(4) The district court may also make an appropriate order for providing maintenance to the child by a party to the marriage or their parents or guardians.
