संपत्ति अंतरण अधिनियम की धारा 127 – दुर्भर दान-
जहां कि दान, एक ही व्यक्ति को ऐसी कई चीजों के एकल अन्तरण के रूप में है जिनमें से एक पर बाध्यता का बोझ है और अन्यों पर नहीं है, जहां आदाता उस दान द्वारा कुछ नहीं पा सकता जब तक कि वह उसे पूर्णतः प्रतिगृहीत नहीं करता।
जहां कि कोई दान कई चीजों के एक ही व्यक्ति को दो या अधिक पृथक् और स्वतन्त्र अन्तरणों के रूप में है, वहां आदाता उनमें से एक को प्रतिगृहीत करने के लिए और अन्यों को लेने से इन्कार करने के लिए स्वतंत्र है चाहे पूर्व कथित फायदाप्रद हो और पश्चात्कथित दुर्भर हो।
निरर्हित व्यक्ति को दुर्भर दान—जो आदाता संविदा करने के लिए अक्षम है और किसी ऐसी सम्पत्ति को, जिस पर बाध्यता का बोझ है, प्रतिगृहीत कर लेता है वह अपने प्रतिग्रह्ण से आबद्ध नहीं है। किंतु यदि संविदा करने के लिए सक्षम होने के पश्चात् और बाध्यता की जानकारी रखते हुए वह दी हुई सम्पत्ति को प्रतिधृत कर लेता है, तो वह ऐसे आबद्ध हो जाता है।
दृष्टांत
(क) क के एक समृद्ध संयुक्त स्टाक कम्पनी भ में अंश है और कठिनाइयों में ग्रस्त एक संयुक्त स्टाक कम्पनीम में भी उसके अंश है। म में के अंशों मद्धे भारी मांगों की प्रत्याशा है । क संयुक्त स्टाक कम्पनियों में के अपने सब अंश ख को दे देता है। म में अंशों को प्रतिगृहीत करने से ख इन्कार करता है वह भ में के अंशों को नहीं ले सकता।
(ख) क ऐसे गृह का पट्टा ख को देता है जो कुछ वर्षों की अवधि के लिए पट्टे पर उस द्वारा ऐसे भाटक पर लिया हआ है, जिस भाटक को अवधि भर तक देने के लिए वह और उसके प्रतिनिधि आबद्ध हैं, और जो उतने से अधिक है जितने पर कि गृह पट्टे पर चढ़ाया जा सकता है, और एक पृथक् और स्वतंत्र संव्यवहार के रूप में उसे एक धनराशि भी देता है । ख पट्टे को प्रतिगृहीत करने से इन्कार करता है। इस इन्कार के कारण उससे धन का समपहरण नहीं हो जाता।
Section 127 TPA – Onerous gifts –
Where a gift is in the form of a single transfer to the same person of several things of which one is, and the others are not, burdened by an obligation, the done can take nothing by the gift unless he accepts it fully. संपत्ति अंतरण अधिनियम की धारा 127
Where a gift is in the form of two or more separate and independent transfers to the same person of several things, the done is at liberty to accept one of them and refuse the others, although the former may be beneficial and the latter onerous.
Onerous gift to disqualified person.— A done not competent to contract and accepting property burdened by any obligation is not bound by his acceptance. But if, after becoming competent to contract and being aware of the obligation, he retains the property given, he becomes so bound. संपत्ति अंतरण अधिनियम की धारा 127
Illustrations
(a) A shares in X, a prosperous joint stock company, and also shares in Y, a joint stock company, in difficulties. Heavy calls are expected in respect of the shares in Y. A given B all his shares in joint stock companies. B refuses to accept the shares in Y. He cannot take the shares in X. संपत्ति अंतरण अधिनियम की धारा 127
(b) A, having a lease for a term of years of a house at a rent which he and his representatives are bound to pay during the term, and which is more than the house can be let for, given to B the lease, and also, as a separate and independent transaction, a sum of money. B refuses to accept the lease. He does not by his refusal forfeit the money.
