धारा 16 भारतीय साक्ष्य अधिनियम – कारबार के अनुक्रम का अस्तित्व कब सुसंगत है —
जबकि प्रश्न यह है कि क्या कोई विशिष्ट कार्य किया गया था, तब कारबार के ऐसे किसी भी अनुक्रम का अस्तित्व, जिसके अनुसार वह कार्य स्वभावतः किया जाता, सुसंगत तथ्य है।
दृष्टांत
(क) प्रश्न यह है कि क्या एक विशिष्ट पत्र प्रेषित किया गया था।
ये तथ्य कि कारबार का यह साधारण अनुक्रम था कि वे सभी पत्र, जो किसी खास स्थान में रख दिए जाते थे, डाक में डाले जाने के लिए ले जाए जाते थे और कि वह पत्र उस स्थान में रख दिया गया था, सुसंगत है।
(ख) प्रश्न यह है कि क्या एक विशिष्ट पत्र क को मिला। ये तथ्य कि वह सम्यक् अनुक्रम में डाक में डाला गया था, और कि वह पुनः प्रेषण केन्द्र द्वारा लौटाया नहीं गया था, सुसंगत है।
Section 16 Indian Evidence Act – Existence of course of business when relevant —
When there is a question whether a particular act was done, the existence of any course of business, according to which it naturally would have been done, is a relevant fact.
Illustrations
(a) The question is, whether a particular letter was despatched.
The facts that it was the ordinary course of business for all letters put in a certain place to be carried to the post, and that the particular letter was put in that place are relevant.
(b) The question is, whether a particular letter reached A. The facts that it was posted in due course, and was not returned through the Dead Letter Office, are relevant.
