धारा 103 भारतीय साक्ष्य अधिनियम – विशिष्ट तथ्य के बारे में सबूत का भार —
किसी विशिष्ट तथ्य के सबूत का भार उस व्यक्ति पर होता है जो न्यायालय से यह चाहता है कि उसके अस्तित्व में विश्वास करे, जब तक कि किसी विधि द्वारा यह उपबंधित न हो कि उस तथ्य के सबूत का भार किसी विशिष्ट व्यक्ति पर होगा।
दृष्टांत
(क) ख को क चोरी के लिए अभियोजित करता है और न्यायालय से यह चाहता है कि न्यायालय यह विश्वास करे कि ख ने चोरी की स्वीकृति ग से की। क को यह स्वीकृति साबित करनी होगी।
(ख) ख न्यायालय से चाहता है कि वह यह विश्वास करे कि प्रश्नगत समय पर वह अन्यत्र था। उसे यह बात साबित करनी होगी।
Section 103 Indian Evidence Act – Burden of proof as to particular fact —
The burden of proof as to any particular fact lies on that person who wishes the Court to believe in its existence, unless it is provided by any law that the proof of that fact shall lie on any particular person.
Illustrations
(a) A prosecutes B for theft, and wishes the Court to believe that B admitted the theft to C. A must prove the admission.
(b) B wishes the Court to believe that, at the time in question, he was elsewhere. He must prove it.
