IPC की धारा 442 — गृह-अतिचार –
जो कोई किसी निर्माण, तम्बू या जलयान में, जो मानव निवास के रूप में उपयोग में आता है, या किसी निर्माण में, जो उपासना-स्थान के रूप में, या किसी संपत्ति की अभिरक्षा के स्थान के रूप में उपयोग में आता है, प्रवेश करके या उसमें बना रहकर, आपराधिक अतिचार करता है, वह “गृह-अतिचार” करता है, यह कहा जाता है।
स्पष्टीकरण — आपराधिक अतिचार करने वाले व्यक्ति के शरीर के किसी भाग का प्रवेश गृह-अतिचार गठित करने के लिए पर्याप्त प्रवेश है।
IPC Section 442 — House trespass –
Whoever commits criminal trespass by entering into or remaining in any building, tent or vessel used as a human dwelling or any building used as a place for worship, or as a place for the custody of property, is said to commit “house-trespass”.
Explanation – The introduction of any part of the criminal trespasser’s body is entering sufficient to constitute house-trespass.
