IPC की धारा 340– सदोष परिरोध –
जो कोई किसी व्यक्ति का इस प्रकार सदोष अवरोध करता है, कि उस व्यक्ति को निश्चित परिसीमा से परे जाने से निवारित कर दे, वह उस व्यक्ति का “सदोष परिरोध” करता है, यह कहा जाता है।
दृष्टांत –
(क) य को दिवार से घिरे हुए स्थान में प्रवेश कराकर क उसमें ताला लगा देता है। इस प्रकार य दीवार की परिसीमा से परे किसी भी दिशा में नहीं जा सकता। क ने य का सदोष परिरोध किया है।
(ख) क एक भवन के बाहर जाने के द्वारों पर बन्दूकधारी मनुष्यों को बैठा देता है और य से कह देता है कि यदि य भवन के बाहर जाने का प्रयत्न करेगा, तो वे य को गोली मार देंगे। क ने य का सदोष परिरोध किया है।
PC Section 340– Wrongful confinement –
Whoever wrongfully restrains any person in such a manner as to prevent that person from proceedings beyond certain circumscribing limits, is said “wrongfully to confine” that person.
Illustrations –
(a) A causes Z to go within a walled space, and locks Z in. A is thus prevented from proceeding in any direction beyond the circumscribing line of wall. A wrongfully confines Z.
(b) A places men with firearms at the outlets of a building, and tells Z that they will fire at Z if Z attempts to leave the building. A wrongfully confines Z.
