IPC की धारा 354C — दृश्यरतिकता –
ऐसा कोई पुरुष, जो कोई ऐसी किसी स्त्री को, जो उन परिस्थितियों के अधीन, जिनमें वह यह प्रत्याशा करती है कि उसे अपराध करने वाला या अपराध करने वाले के कहने पर कोई अन्य व्यक्ति देख नहीं रहा होगा, किसी प्राइवेट कृत्य में लगी किसी स्त्री को एकटक देखेगा या उसका चित्र खींचेगा अथवा उस चित्र को प्रसारित करेगा, प्रथम दोषसिद्धि पर दोनों में से किसी भांति के कारावास से, जिसकी अवधि एक वर्ष से कम की नहीं होगी किन्तु जो तीन वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने से भी दंडित किया जाएगा और द्वितीय अथवा पश्चात्वर्ती किसी दोषसिद्धि पर दोनों में से किसी भांति के कारावास से, जिसकी अवधि तीन वर्ष से कम की नहीं होगी किन्तु जो सात वर्ष तक की हो सकेगी, दंडित किया जाएगा और जुर्माने से भी दण्डनीय होगा।
स्पष्टीकरण 1- इस धारा के प्रयोजनों के लिये, “प्राइवेट कृत्य” के अंतर्गत ऐसे किसी स्थान में देखने का कार्य किया जाता है, जिसके संबंध में, परिस्थितियों के अधीन, युक्तियुक्त रूप से यह प्रत्याशा की जाती है कि वहां एकांतता होगी और जहां कि पीड़िता के जननांगों, नितंबों या वक्षस्थलों को अभिदर्शित किया जाता है या केवल अधोवस्त्र से ढंका जाता है अथवा जहां पीड़िता किसी शौचघर का प्रयोग कर रही है; या जहां पीड़िता ऐसा कोई लैंगिक कृत्य कर रही है जो ऐसे प्रकार का नहीं है जो साधारणतया सार्वजनिक तौर पर किया जाता है।
स्पष्टीकरण 2- जहां पीड़िता चित्रों या किसी अभिनय के चित्र को खींचने के लिए सम्मति देती है किन्तु अन्य व्यक्तियों को उन्हें प्रसारित करने की सम्मति नहीं देती है और जहां उस चित्र या कृत्य का प्रसारण किया जाता है वहां ऐसे प्रसारण को इस धारा की अधीन अपराध माना जाएगा।
| अपराध का वर्गीकरण–इस धारा के अधीन अपराध, संज्ञेय, प्रथम दोषसिद्धि के लिये जमानतीय एवं द्वितीय या पश्चातवर्ती दोषसिद्धि के लिये अजमानतीय, अशमनीय, और कोई भी मजिस्ट्रेट द्वारा विचारणीय है| |
IPC Section 354C — Voyeurism –
Any man who watches, or captures the image of a woman engaging in a private act in circumstances where she would usually have the expectation of not being observed either by the perpetrator or by any other person at the behest of the perpetrator or disseminates such image shall be punished on first conviction with imprisonment of either description for a term which shall not be less than one year, but which may extend to three years, and shall also be liable to fine, and be punished on a second or subsequent conviction, with imprisonment of either description for a term which shall not be less than three years, but which may extend to seven years, and shall also be liable to fine. Explanation 1 – For the purpose of this section, “private act” includes an act of watching carried out in a place which, in the circumstances, would reasonably be expected to provide privacy and where the victim’s genitals, posterior or breasts are exposed or covered only in underwear, or the victim is using a lavatory; or the victim is doing a sexual act that is not of a kind ordinarily done in public, IPC की धारा 354C
Explanation 2 – Where the victim consents to the capture of images or any act, but not to their dissemination to third persons and where such image or act is disseminated, such dissemination shall be considered an offence under this section.
