IPC की धारा 416 — प्रतिरूपण द्वारा छल –
कोई व्यक्ति “प्रतिरूपण” द्वारा छल करता है, यह तब कहा जाता है, जब वह यह अपदेश करके कि वह कोई अन्य व्यक्ति है, या एक व्यक्ति को किसी अन्य व्यक्ति के रूप में जानते हुए प्रतिस्थापित करके, या यह व्यपदिष्ट करके कि वह या कोई अन्य व्यक्ति, कोई ऐसा व्यक्ति है, जो वस्तुतः उससे या अन्य व्यक्ति से भिन्न है, छल करता है।
स्पष्टीकरण – यह अपराध हो जाता है चाहे वह व्यक्ति जिसका प्रतिरूपण किया गया है, वास्तविक व्यक्ति हो या काल्पनिक।
दृष्टांत –
(क) क, उसी नाम का अमुक धनवान बैंकर है इस अपदेश द्वारा छल करता है। क प्रतिरूपण द्वारा छल करता है।
(ख) ख, जिसकी मृत्यु हो चुकी है, होने का अपदेश करने द्वारा क छल करता है। क प्रतिरूपण द्वारा छल करता है।
IPC Section 416 — Cheating by personation –
A person is said to “cheat by personation” if he cheats by pretending to be some other person, or by knowingly substituting one person for another, or representing that he or any other person is a person other than he or such other person really is.
Explanation – The offence is committed whether the individual personated is a real or imaginary person.
Illustration –
(a) A cheats by pretending to be a certain rich banker of the same name. A cheats
by personation.
(b) A cheats by pretending to be B, a person who is deceased. A cheats by personation.
