IPC की धारा 508 — व्यक्ति को यह विश्वास करने के लिए उत्प्रेरित करके कि वह दैवी अप्रसाद का भाजन होगा कराया गया कार्य —
जो कोई किसी व्यक्ति को यह विश्वास करने के लिये उत्प्रेरित करके या उत्प्रेरित करने का प्रयत्न करके, कि यदि वह उस बात को न करेगा, जिसे उससे कराना अपराधी का उद्देश्य हो, या यदि वह उस बात को करेगा, जिसका उससे लोप कराना अपराधी का उद्देश्य हो, तो वह या कोई व्यक्ति, जिससे वह हितबद्ध है, अपराधी के किसी कार्य से दैवी अप्रसाद का भाजन हो जाएगा या बना दिया जाएगा, स्वेच्छया उस व्यक्ति से कोई ऐसी बात करवायेगा या करवाने का प्रयत्न करेगा, जिसे करने के लिये वह वैध रूप से आबद्ध न हो या किसी ऐसी बात के करने का लोप करवायेगा या करवाने का प्रयत्न करेगा, जिसे करने के लिए वह वैध रूप से हकदार हो, वह दोनों में से किसी भाँति के कारावास से, जिसकी अवधि एक वर्ष तक की हो सकेगी या जुर्माने से, या दोनों से, दण्डित किया जायेगा।
दृष्टान्त –
(क) क, यह विश्वास कराने के आशय से व के द्वार पर धरना देता हे कि इस प्रकार धरना देने से वह य को दैवी अप्रसाद का भाजन बना रहा है। क ने इस धारा में परिभाषित अपराध किया है।
(ख) क, य को धमकी देता है, कि यदि य अमुक कार्य नहीं करेगा, तो क अपने बच्चों में से किसी एक का वध ऐसी परिस्थितियों में कर डालेगा, जिससे ऐसे वध करने के परिणामस्वरूप यह विश्वास किया जाये, कि य दैवी अप्रसाद का भाजन बना दिया गया है। क ने इस धारा में परिभाषित अपराध किया है।
| अपराध का वर्गीकरण-– इस धारा के अधीन अपराध, असंज्ञेय, जमानतीय और कोई भी मजिस्ट्रेट द्वारा विचारणीय है । द.प्र. सं. (संशोधन) अधिनियम, 2008 ( क्र. 5 सन् 2009) की धारा 23 (i) द्वारा दिनांक 31-12-2009 से इस धारा के अधीन अपराध को उत्प्रेरित व्यक्ति द्वारा शमनीय बनाया गया है | |
IPC Section 508 — Act caused by inducing person to believe that he will be rendered an object to the Divine displeasure. –
Whoever voluntarily causes or attempts to cause any person to do anything which that person is not legally bound to do, or to omit to do anything which he is legally entitled to do, by inducing or attempting to induce that person to believe that he or any person in whom he is interested will become or will be rendered by some act of the offender an object of Divine displeasure if he does not do the thing which it is the object of the offender lo cause him to do or if he does the thing which it is the object of the offender to cause him to omit shall be punished with imprisonment of either description tor a term which may extend to one year, or with fine, or with both.
