धारा 18 आईटी एक्ट 2000 – नियंत्रक के कृत्य-–
नियंत्रक निम्नलिखित सभी या किन्हीं कृत्यों का निष्पादन कर सकेगा, अर्थात् :-
(क) प्रमाणकर्ता प्राधिकारियों के क्रियाकलापों का पर्यवेक्षण करना;
(ख) प्रमाणकर्ता प्राधिकारियों की लोक कुंजियों को प्रमाणित करना;
(ग) प्रमाणकर्ता प्राधिकारियों द्वारा बनाये रखे जाने वाले मानक अधिकथित करना;
(घ) ऐसी अर्हताएं और अनुभव विनिर्दिष्ट करना जो प्रमाणकर्ता प्राधिकारी के कर्मचारियों के पास होनी चाहिए;
(ङ) ऐसी शर्तें विनिर्दिष्ट करना जिनके अधीन प्रमाणकर्ता प्राधिकारी अपना कार्य करेगा;
(च) लिखित, मुद्रित या दृश्य सामग्री और विज्ञापनों की अन्तर्वस्तु विनिर्दिष्ट करना, जिसके इलेक्ट्रॉनिक चिह्नक प्रमाणपत्र और लोक कुंजी की बाबत वितरण या उपयोग किया जा सके;
(छ) किसी इलेक्ट्रॉनिक चिह्नक प्रमाणपत्र और कुंजी का रूप और अन्तर्वस्तु विनिर्दिष्ट करना;
(ज) वह प्ररूप और रीति विनिर्दिष्ट करना, जिसमें प्रमाणकर्ता प्राधिकारियों द्वारा लेखे रखे जाएंगे;
(झ) उन निबंधनों और शर्तों को विनिर्दिष्ट करना, जिनके अधीन लेखा-परीक्षकों की नियुक्ति की जा सकेगी और उनको पारिश्रमिक संदत्त किया जा सकेगा;
(ञ) प्रमाणकर्ता प्राधिकारी द्वारा, अकेले या अन्य प्रमाणकर्ता प्राधिकारियों के साथ संयुक्त रूप से किसी इलेक्ट्रॉनिक प्रणाली के स्थापन और ऐसी प्रणाली के विनियमन को सुकर बनाना;
(ट) वह रीति विनिर्दिष्ट करना, जिसमें प्रमाणकर्ता प्राधिकारी उपयोगकर्ताओं के साथ व्यवहार करेंगे;
(ठ) प्रमाणकर्ता प्राधिकारी और उनके उपयोगकर्ताओं के बीच हितों के किसी टकराव का समाधान करना;
(ड) प्रमाणकर्ता प्राधिकारियों के कर्तव्यों को अधिकथित करना;
(ढ) ऐसा डाटा संचय रखना जिसमें प्रत्येक प्रमाणकर्ता प्राधिकारी का प्रकटन अभिलेख हो, जिसमें ऐसी विशिष्टियां अंतर्विष्ट हों, जो विनियमों द्वारा विनिर्दिष्ट की जाएं और जो जनता की पहुंच में हों।
Section 18 IT Act 2000 – Functions of Controller–
The Controller may perform all or any of the following functions, namely:–
(a) exercising supervision over the activities of the Certifying Authorities;
(b) certifying public keys of the Certifying Authorities;
(c) laying down the standards to be maintained by the Certifying Authorities;
(d) specifying the qualifications and experience which employees of the Certifying Authority should possess;
(e) specifying the conditions subject to which the Certifying Authorities shall conduct their business;
(f) specifying the contents of written, printed or visual materials and advertisements that may be distributed or used in respect of a 1 [electronic signature] Certificate and the public key;
(g) specifying the form and content of a 1 [electronic signature] Certificate and the key; धारा 18 आईटी एक्ट 2000
(h) specifying the form and manner in which accounts shall be maintained by the Certifying Authorities;
(i) specifying the terms and conditions subject to which auditors may be appointed and the remuneration to be paid to them;
(j) facilitating the establishment of any electronic system by a Certifying Authority either solely or jointly with other Certifying Authorities and regulation of such systems; धारा 18 आईटी एक्ट 2000
(k) specifying the manner in which the Certifying Authorities shall conduct their dealings with the subscribers;
(l) resolving any conflict of interests between the Certifying Authorities and the subscribers;
(m) laying down the duties of the Certifying Authorities;
(n) maintaining a data base containing the disclosure record of every Certifying Authority containing such particulars as may be specified by regulations, which shall be accessible to public.
