धारा 42 विनिर्दिष्ट अनुतोष अधिनियम — नकारात्मक करार के पालन का व्यादेश–
धारा 41 के खण्ड (ङ) में अन्तर्विष्ट किसी बात के होते हुए भी, जहाँ किसी संविदा में कतिपय कार्य को करने के सकारात्मक करार के साथ कतिपय कार्य को न करने का, अभिव्यक्त या विवक्षित, कोई नकारात्मक करार समाविष्ट हो, परिस्थितियाँ कि न्यायालय सकारात्मक करार के विनिर्दिष्ट पालन को विवश करने में असमर्थ है, उसे नकारात्मक करार के पालन करने के किसी व्यादेश को अनुदत्त करने से प्रवारित नहीं करेगी :
परन्तु यह कि वादी संविदा का पालन, जहाँ तक उस पर वह आबद्धकर है, करने में विफल न रहा हो ।
Section 42 Specific Relief Act — Injunction to perform negative agreement —
Notwithstanding anything contained in clause (e) of section 41, where a contract comprises an affirmative agreement to do a certain act, coupled with a negative agreement, express or implied, not to do a certain act, the circumstance that the court is unable to compel specific performance of the affirmative agreement shall not preclude it from granting an injunction to perform the negative agreement:
Provided that the plaintiff has not failed to perform the contract so far as it is binding on him.
