धारा 5 मध्यप्रदेश विशेष न्यायलय अधिनियम — इस अधिनियम के अधीन विचार किए जाने वाले मामलों की घोषणा —
(1) जहाँ राज्य सरकार को प्रथम दृष्टया साक्ष्य के आधार पर यह विश्वास करने का कारण हो कि किसी ऐसे व्यक्ति द्वारा कथित रूप से किए गए किसी अपराध के किए जाने का समुचित आधार है, जो लोक पद धारण कर चुका हो अथवा धारण कर रहा हो और जो अधिनियम की धारा 2(ग) के अर्थ के अन्तर्गत मध्यप्रदेश राज्य में लोक सेवक हो या रह चुका हो, तो राज्य सरकार ऐसे प्रत्येक मामले में, जिसमें कि उसका उपरोक्त विश्वास हो, उस आशय की घोषणा करेगी ।
(2) ऐसी घोषणा को किसी भी न्यायालय में प्रश्नगत नहीं किया जाएगा।
Declaration of cases to be dealt with under this Act. –
(1) Where the State Government, on the basis of prima-facie evidence, have reasons to believe that appropriate grounds exists about the commission of an offence alleged to have been committed by a person, who has held or is holding public office and is or has been public servant within the meaning of Section 2(c) of the Act in the State of Madhya Pradesh, the State Government shall make a declaration to that effect in every case in which it is of the aforesaid belief.
(2) Such declaration shall not be called in question in any Court.
