धारा 82 किशोर न्याय अधिनियम 2015 – शारीरिक दंड –
(1) किसी बालक देखरेख संस्था का भारसाधक या उसमें नियोजित कोई व्यक्ति, जो किसी बालक को अनुशासनबद्ध करने के उद्देश्य से भी जानबूझकर किसी बालक को शारीरिक दंड देगा, वह प्रथम दोषसिद्धि पर दस हजार रुपए के जुर्माने से और प्रत्येक पश्चातवर्ती अपराध के लिए ऐसे कारावास से, जिसकी अवधि तीन मास तक की हो सकेगी या जुर्माने से या दोनों से, दंडनीय होगा ।
(2) यदि उपधारा (1) में निर्दिष्ट संस्था में नियोजित कोई व्यक्ति, उस उपधारा के अधीन किसी अपराध का
दोषसिद्ध होता है तो ऐसा व्यक्ति सेवा से पदच्युति का भी दायी होगा और उसे उसके पश्चात् प्रत्यक्षतः
बालकों के साथ कार्य करने से विवर्जित कर दिया जाएगा।
(3) ऐसे मामले में, जहां उपधारा (1) में निर्दिष्ट किसी संस्था में किसी शारीरिक दंड की रिपोर्ट की जाती है और
ऐसी संस्था का प्रबंधतंत्र किसी जांच में सहयोग नहीं करता है या समिति या बोर्ड या न्यायालय या राज्य
सरकार के आदेशों का अनुपालन नहीं करता है, वहां ऐसी संस्था के प्रबंधतंत्र का भारसाधक व्यक्ति, ऐसे
कारावास से, जिसकी अवधि तीन वर्ष से कम की नहीं होगी और वह जुर्माने से भी, जो एक लाख रुपए तक
का हो सकेगा, दंडनीय होगा ।
Section 82 Juvenile Justice Act 2015 – Corporal punishment–
(1) Any person in-charge of or employed in a child care institution, who subjects a child to corporal punishment with the aim of disciplining the child, shall be liable, on the first conviction, to a fine of ten thousand rupees and for every subsequent offence, shall be liable for imprisonment which may extend to three months or fine or with both.
(2) If a person employed in an institution referred to in sub-section (1), is convicted of an offence under that sub-section, such person shall also be liable for dismissal from service, and shall also be debarred from working directly with children thereafter. धारा 82 किशोर न्याय अधिनियम 2015
(3) In case, where any corporal punishment is reported in an institution referred to in sub-section (1) and the management of such institution does not cooperate with any inquiry or comply with the orders of the Committee or the Board or court or State Government, the person in-charge of the management of the institution shall be liable for punishment with imprisonment for a term not less than three years and shall also be liable to fine which may extend to one lakh rupees.
