धारा 15 एनडीपीएस एक्ट — पोस्त तृण के संबंध में उल्लंघन के लिए दंड –
जो कोई, इस अधिनियम के किसी उपबंध या इसके अधीन बनाए गए किसी नियम या निकाले गए किसी आदेश या दी गई किसी अनुज्ञप्ति की शर्त के उल्लंघन में पोस्त तृण का उत्पादन, कब्जा, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, विक्रय, क्रय, उपयोग करेगा या उसको भांडागारण में रखने का लोप करेगा या भांडागारित पोस्त तृण को हटाएगा या उसकी बाबत कोई कार्य करेगा, वह –
(क) जहां उल्लंघन अल्प मात्रा से संबंधित है, वहां कठोर कारावास से, जिसकी अवधि एक वर्ष तक की हो सकेगी, या जुर्माने से, जो दस हजार रुपए तक का हो सकेगा, अथवा दोनों से;
(ख) जहां उल्लंघन वाणिज्यिक मात्रा से कम किंतु अल्प मात्रा से अधिक मात्रा से संबंधित है, वहां कठोर कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी और जुर्माने से जो एक लाख रुपए तक का हो सकेगा;
(ग) जहां उल्लंघन वाणिज्यिक मात्रा से संबंधित है, वहां कठोर कारावास से, जिसकी अवधि दस वर्ष से कम की नहीं होगी किंतु बीस वर्ष तक की हो सकेगी और जुर्माने से भी, जो एक लाख रुपए से कम का नहीं होगा किंतु दो लाख रुपए तक का हो सकेगा, दंडनीय होगा:
परंतु न्यायालय, ऐसे कारणों से, जो निर्णय में लेखबद्ध किए जाएंगे, दो लाख रुपए से अधिक का जुर्माना अधिरोपित कर सकेगा ।
15 NDPS Act in Hindi — Punishment for contravention in relation to poppy straw.–
Whoever, in contravention of any provisions of this Act or any rule or order made or condition of a licence granted thereunder, produces, possesses, transports, imports inter-State, exports inter-State, sells, purchases, uses or omits to warehouse poppy straw or removes or does any act in respect of warehoused poppy straw shall be punishable,–
(a) where the contravention involves small quantity, with rigorous imprisonment for a term which may extend to 2[one year], or with fine which may extend to ten thousand rupees, or with both;
(b) where the contravention involves quantity lesser than commercial quantity but greater than small quantity, with rigorous imprisonment for a term which may extend to ten years, and with fine which may extend to one lakh rupees; धारा 15 एनडीपीएस एक्ट
(c) where the contravention involves commercial quantity, with rigorous imprisonment for a term which shall not be less than ten years but which may extend to twenty years, and shall also be liable to fine which shall not be less than one lakh rupees but which may extend to two lakh rupees:
Provided that the court may, for reasons to be recorded in the judgment, impose a fine exceeding two lakh rupees.]
