धारा 18 मध्यप्रदेश विशेष न्यायलय अधिनियम — कब्जा लेने की शक्ति —
(1) जहाँ इस अधिनियम के अधीन, कोई धन या संपत्ति या दोनों राज्य सरकार को अधिहृत हो गए हों वहाँ सम्बन्धित प्राधिकृत अधिकारी प्रभावित व्यक्ति के साथ-साथ किसी अन्य व्यक्ति को, जिसके कब्जे में धन या सम्पत्ति या दोनों हों, आदेश देगा कि वह आदेश तामील किए जाने के तीस दिन के भीतर सम्बन्धित प्राधिकृत अधिकारी को या इस निमित्त उसके द्वारा सम्यक् रूप से प्राधिकृत किसी अन्य व्यक्ति को अभ्यर्पित कर दे अथवा उसका कब्जा दे दे:
परन्तु प्राधिकृत अधिकारी इस निमित्त आवेदन दिए जाने पर तथा यह समाधान कर लेने पर कि प्रभावित व्यक्ति प्रश्नगत सम्पत्ति में निवास कर रहा है उसे उससे तत्काल बेदखल करने के बदले में ऐसे व्यक्ति को विनिर्दिष्ट की जाने वाली सीमित कालावधि तक के लिए राज्य सरकार को बाजार दर का भुगतान कर उसका कब्जा बनाए रखने की अनुमति दे सकेगा और उसके पश्चात् ऐसा व्यक्ति उस सम्पत्ति का खाली कब्जा सौंप देगा ।
(2) यदि कोई व्यक्ति उपधारा (1) के अधीन किए गए आदेश का पालन करने से इंकार करता है या पालन करने में असफल रहता है तो प्राधिकृत अधिकारी संपत्ति को कब्जे में ले सकेगा और उस प्रयोजन के लिये ऐसे बल का प्रयोग कर सकेगा जैसा कि आवश्यक हो ।
(3) उपधारा (2) में अंतर्विष्ट किसी बात के होते हुए भी, प्राधिकृत अधिकारी उपधारा (1) में निर्दिष्ट किसी धन या सम्पत्ति या दोनों का कब्जा लेने के प्रयोजन के लिए सहायता के लिए किसी पुलिस अधिकारी की सेवा की अध्यपेक्षा कर सकेगा और ऐसी अध्यपेक्षा का अनुपालन करना ऐसे अधिकारी का आबद्धकारी कर्तव्य होगा ।
Power to make possession —
(1) Where any money or property or both have been confiscated to the State Government under this Act, the concerned Authorized Officer shall order the person affected, as well as any other person, who may be in possession of the money or property or both to surrender or deliver possession thereof to the concerned Authorized Officer or to any person duly authorized by him in this behalf, within thirty days of the service of the order: धारा 18 मध्यप्रदेश विशेष न्यायलय अधिनियम
Provided that the Authorized Officer, on an application made in that behalf and being satisfied that the person affected is residing in the property in question, may instead of dispossessing him immediately from the same, permit such person to occupy it for a limited period to be specified on payment of market rent to the State Government and thereafter, such person shall deliver the vacant possession of the property. धारा 18 मध्यप्रदेश विशेष न्यायलय अधिनियम
(2) If any person refuses or fails to comply with an order made under sub-section (1), the Authorized Officer may take possession of the property and may, for that purpose, use such force as may be necessary.
(3) Notwithstanding anything contained in sub-section (2), the Authorized Officer may, for the purpose of taking possession of any money or property or both referred to in sub-section (1), requisition the service of any Police Officer to assist and it shall be the bounden duty of such officer to comply with such requisition.
