धारा 37 सूचना प्रौधोगिकी अधिनियम 2000 — अंकीय चिह्नक प्रमाणपत्र का निलंबन—
(1) ऐसा प्रमाणकर्ता प्राधिकारी जिसने अंकीय चिह्नक प्रमाणपत्र जारी किया है, उपधारा (2) के उपबंधों के अधीन रहते हुए–
(क) (i) अंकीय चिह्नक प्रमाणपत्र में सूचीबद्ध उपयोगकर्ता से;
(ii) उस उपयोगकर्ता की ओर से कार्य करने के लिए सम्यक् रूप से प्राधिकृत किसी व्यक्ति से, उस आशय के अनुरोध की प्राप्ति पर;
(ख) यदि उसकी यह राय है कि अंकीय चिह्नक प्रमाणपत्र लोकहित में निलंबित किया जाना चाहिए । ऐसे अंकीय चिह्नक प्रमाणपत्र को निलंबित कर सकेगा ।
(2) अंकीय चिह्नक प्रमाणपत्र पन्द्रह दिन से अधिक के लिए तब तक निलंबित नहीं किया जाएगा जब तक कि उपयोगकर्ता को उस विषय पर सुने जाने का अवसर न दे दिया गया हो ।
(3) इस धारा के अंकीय चिह्नक प्रमाणपत्र के निलंबन पर प्रमाणकर्ता प्राधिकारी उपयोगकर्ता को उसकी संसूचना देगा |
Section 37 IT Act 2000 — Suspension of Digital Signature Certificate —
(1) Subject to the provisions of sub-section (2), the Certifying Authority which has issued a Digital Signature Certificate may suspend such Digital Signature Certificate,–
(a) on receipt of a request to that effect from–
(i) the subscriber listed in the Digital Signature Certificate; or
(ii) any person duly authorised to act on behalf of that subscriber;
(b) if it is of opinion that the Digital Signature Certificate should be suspended in public interest.
(2) A Digital Signature Certificate shall not be suspended for a period exceeding fifteen days unless the subscriber has been given an opportunity of being heard in the matter.
(3) On suspension of a Digital Signature Certificate under this section, the Certifying Authority shall communicate the same to the subscriber.
