धारा 39 विनिर्दिष्ट अनुतोष अधिनियम — आज्ञापक व्यादेश ––
जब, किसी बाध्यता के भंग को निवारित करने के लिये, कतिपय कार्यों के पालन को विवश करना आवश्यक हो जिनको प्रवर्तित करने के लिये न्यायालय समर्थ हो, न्यायालय, स्वविवेकानुसार, परिवादित भंग को निवारित करने और अपेक्षित कार्यों के पालन को विवश करने के लिये भी कोई व्यादेश अनुदत्त कर सकेगा ।
Section 39 Specific Relief Act — Mandatory injunctions —
When, to prevent the breach of an obligation, it is necessary to compel the performance of certain acts which the court is capable of enforcing, the court may in its discretion grant an injunction to prevent the breach complained of, and also to compel performance of the requisite acts.
