धारा 47 सूचना प्रौधोगिकी अधिनियम 2000 — न्यायनिर्णायक अधिकारी द्वारा विचार की जाने वाली बातें –
इस अध्याय के अधीन प्रतिकर की मात्रा का न्यायनिर्णयन करते समय, न्यायनिर्णायक अधिकारी, निम्नलिखित बातों पर सम्यक् ध्यान देगा, अर्थात् :
(क) व्यतिक्रम के परिणामस्वरूप हुए अभिलाभ या अनुचित फायदे की रकम, जहां वह परिमाण निर्धारण योग्य हो;
(ख) व्यतिक्रम के परिणामस्वरूप किसी व्यक्ति को हुई हानि की रकम ;
(ग) व्यतिक्रम की आवृत्तीय प्रकृति ।
Section 47 IT Act 2000 — Factors to be taken into account by the adjudicating officer —
While adjudging the quantum of compensation under this Chapter, the adjudicating officer shall have due regard to the following factors, namely:–
(a) the amount of gain of unfair advantage, wherever quantifiable, made as a result of the default;
(b) the amount of loss caused to any person as a result of the default;
(c) the repetitive nature of the default.
