जबकि कोई संविदा साथ-साथ पालन किए जाने वाले व्यतिकारी वचनों से गठित हो तब किसी भी वचनदाता के लिए अपने वचन का पालन करना आवश्यक नहीं है जब तक कि वचनग्रहीता अपने व्यतिकारी वचन का पालन करने के लिए तैयार और रजामन्द न हो।
दृष्टान्त
(क) ‘क’ और ‘ख’ संविदा करते हैं कि ‘ख’ को ‘क’ माल परिदत्त करेगा जिसके लिए संदाय माल के परिदान पर ‘ख’ द्वारा किया जाएगा। माल का परिदान करना ‘क’ के लिए आवश्यक नहीं है जब तक कि ‘ख’ परिदान पर माल के लिए संदाय करने को तैयार और रजामन्द न हो। |
माल के लिए संदाय करना ‘ख’ के लिए आवश्यक नहीं है जब तक कि संदाय पर माल को परिदत्त करने के लिए ‘क’ तैयार और रजामन्द न हो।
(ख) ‘क’ और ‘ख’ संविदा करते हैं कि ‘क’ किस्तों में दी जाने वाली कीमत पर ‘ख’ को माल परिदत्त करेगा और पहली किस्त परिदान पर दी जानी है। माल का परिदान करना ‘क’ के लिए आवश्यक नहीं है जब तक कि ‘ख’ परिदान पर पहली किस्त देने के लिए तैयार और रजामन्द न हो।

Section 51 Indian Contract Act — Promisor not bound to perform, unless reciprocal promisee ready and willing to perform –
When a contract consists of reciprocal promises to be simultaneously performed, no promisor need perform his promise unless the promisee is ready and willing to perform his reciprocal promise.
Illustrations
