धारा 76 एनडीपीएस एक्ट — नियम बनाने की केन्द्रीय सरकार की शक्ति –
(1) इस अधिनियम के अन्य उपबन्धों के अधीन रहते हुए केन्द्रीय सरकार, इस अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए नियम राजपत्र में अधिसूचना द्वारा बना सकेगी ।
(2) पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियम निम्नलिखित सभी या किन्हीं विषयों के लिए उपबन्ध कर सकेंगे, अर्थात्: –
(क) वह पद्धति, जिसके द्वारा धारा 2 के खण्ड (v), खण्ड (vi), खण्ड (xiv) और खण्ड (xv) के प्रयोजनों के लिए द्रव निर्मितियों की दशा में प्रतिशतताओं का परिकलन किया जाएगा;
(ख) उस बन्धपत्र का प्ररूप, जो परिशान्ति बनाए रखने के लिए धारा 34 के अधीन निष्पादित किया जाएगा;
(ग) उस बन्धपत्र का प्ररूप, जो धारा 39 की उपधारा (1) के अधीन चिकित्सीय उपचार के लिए सिद्धदोष किसी व्यसनी व्यक्ति की निर्मुक्ति के लिए निष्पादित किया जाएगा और वह बन्धपत्र, जो उस धारा की उपधारा (2) के अधीन सम्यक् भर्त्सना के पश्चात् ऐसे सिद्धदोष व्यक्ति द्वारा अपनी निर्मुक्ति के पूर्व निष्पादित किया जाएगा;
(गक) वह रीति, जिसमें धारा 50क के अधीन “नियंत्रित परिदान” का जिम्मा लिया जाएगा;
(घ) यह प्राधिकारी या व्यक्ति जिसके द्वारा और वह रीति जिससे भारत से बाहर किसी स्थान से प्राप्त दस्तावेज धारा 66 के खण्ड (ii) के अधीन अधिप्रमाणित की जाएगी;
(घक) वह रीति जिससे और वे शर्तें जिनके अधीन धारा 68छ की उपधारा (2) के अधीन प्रशासक द्वारा संपत्तियों का प्रबंध किया जाएगा;
(घग) वे फ़ीसें जिनका संदाय धारा 68ण की उपधारा (6) के अधीन अपील अधिकरण के अभिलेखों और रजिस्टरों के निरीक्षण के लिए या उनके किसी भाग की प्रमाणित प्रतिलिपि प्राप्त करने के लिए किया जाएगा;
(घघ) सिविल न्यायालय की शक्तियां जिनका प्रयोग धारा 68द के खंड (च) के अधीन सक्षम प्राधिकारी और अपील अधिकरण द्वारा किया जा सकेगा;
(घङ) इस अधिनियम के अधीन अधिकृत सभी वस्तुओं या चीजों का निपटारा;
(घच) नमूने लेना और ऐसे नमूनों का परीक्षण और विश्लेषण करना;
(घछ) अधिकारियों, भेदियों और अन्य व्यक्तियों को सदंत्त किए जाने वाले पुरस्कार;
(ङ) वे शर्तें जिनमें और वह रीति जिससे धारा 73 की उपधारा (1) के अधीन केन्द्रीय सरकार के पास रजिस्ट्रीकृत व्यसनियों और अन्य व्यक्तियों को चिकित्सीय आवश्यकता के लिए स्वापक औषधियों और मनःप्रभावी पदार्थों का प्रदाय किया जा सकेगा;
(च) धारा 71 की उपधारा (1) के अधीन केन्द्रीय सरकार द्वारा स्थापित केन्द्रों की स्थापना, नियुक्ति, अनुरक्षण, प्रबन्ध और अधीक्षण तथा ऐसे केन्द्रों में नियोजित व्यक्तियों को नियुक्ति, प्रशिक्षण, शक्तियां और कर्तव्य;
(छ) धारा 6 की उपधारा (5) के अधीन स्वापक औषधि और मनःप्रभावी पदार्थ सलाहकार समिति के अध्यक्ष और सदस्यों की पदावधि, आकस्मिक रिक्तियों को भरने की रीति और उनको संदेय भत्ते तथा वे शर्तें और निर्बंन्धन, जिनके अधीन रहते हुए कोई गैर सदस्य किसी उपसमिति में नियुक्त किया जा सकेगा;
(ज) कोई अन्य विषय जो विहित किया जाता है या विहित किया जाए ।
Section 76 NDPS Act — Power of Central Government to make rules —
(1) Subject to the other provisions of this Act, the Central Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.
(2) Without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:–
(a) the method by which percentages in the case of liquid preparations shall be calculated for the purposes of clauses (v), (vi) (xiv) and (xv) of section 2;
(b) the form of bond to keep the peace to be executed under section 34;
(c) the form of bond to be executed for release of an addict convict for medical treatment under sub-section (1) of section 39 and the bond to be executed by such convict before his release after due admonition under sub-section (2) of that section;
1[(ca) the manner in which controlled delivery under section 50A is to be undertaken;]
(d) the authority or the person by whom and the manner in which a document received from any place outside India shall be authenticated under clause (ii) of section 66;

(dc) the fees which shall be paid for the inspection of the records and registers of the Appellate Tribunal or for obtaining the certified copy of any part thereof under sub-section (6) of section 68-O;
(dd) the powers of a civil court that may be exercised by the competent authority and the Appellate Tribunal under clause (f) of section 68R; धारा 76 एनडीपीएस एक्ट
(de) the disposal of all articles or things confiscated under this Act;
(df) the drawing of samples and testing and analysis of such samples;
(dg) the rewards to be paid to the officers, informers and other persons;]
(e) the conditions and the manner in which narcotic drugs and psychotropic substances may be supplied for medical necessity to the addicts registered with the Central Government and to others under sub-section (1) of section 71; धारा 76 एनडीपीएस एक्ट
(f) the establishment, appointment, maintenance, management and superintendence of centres established by the Central Government under sub-section (1) of section 71 and appointment, training, powers and duties of persons employed in such centres;
(g) the term of office of, the manner of filling casual vacancies of, and the allowances payable to, the Chairman and members of the Narcotic Drugs and Psychotropic Substances Consultative Committee and the conditions and restrictions subject to which a non-member may be appointed to a sub-committee under sub-section (5) of section 6;
(h) any other matter which is to be, or may be, prescribed.
