धारा 9 एनडीपीएस एक्ट —अनुज्ञा देने, नियंत्रण और विनियमन करने की केन्द्रीय सरकार की शक्ति –
(1) धारा 8 के उपबन्धों के अधीन रहते हुए, केन्द्रीय सरकार, नियमों द्वारा-
(क) निम्नलिखित के लिए अनुज्ञा दे सकेगी और उनका विनियमन कर सकेगी-
(i) कोका के पौधे की खेती या उसके किसी भाग का संग्रह (जब ऐसी खेती या संग्रह केवल केन्द्रीय सरकार के लिए ही हो) या कोका की पत्तियों का उत्पादन, कब्जा, विक्रय, क्रय, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, उपयोग या उपभोग;
(ii) अफीम पोस्त की खेती (जब ऐसी खेती केन्द्रीय सरकार के लिए ही हो);
(iii) अफीम का उत्पादन और विनिर्माण तथा पोस्त तृण का उत्पादन;
(iiiक) ऐसे पौधों से, जिनसे चीरा लगाकर रस नहीं निकाला गया है, उत्पादित पोस्त तृण का कब्जा रखने, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, भांडागारण, विक्रय, क्रय, उपभोग और उपयोग;
(iv) भारत से निर्यात या राज्य सरकारों या विनिर्माण करने वाले रसायनज्ञों को विक्रय के लिए केन्द्रीय सरकार का कारखानों से अफीम और अफीम के व्युत्पादों का विक्रय;
(v) विनिर्मित औषधियों (निर्मित अफीम से भिन्न) का विनिर्माण किन्तु इसके अन्तर्गत औषधीय अफीम या ऐसी सामग्री से, जिसका कब्जा रखने के लिए बनाने वाला विधिसम्मत रूप से हकदार है, विनिर्मित औषधि अंतर्विष्ट करने वाली किसी निर्मिति का विनिर्माण नहीं है;
(vक) आवश्यक स्वापक औषधियों का विनिर्माण, कब्जा, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, विक्रय, क्रय, उपभोग और उपयोग:
परंतु जहां किसी आवश्यक स्वापक औषधि की बाबत, राज्य सरकार ने स्वापक औषधि और मनःप्रभावी पदार्थ (संशोधन) अधिनियम, 2014 के प्रारंभ से पूर्व धारा 10 के उपबंधों के अधीन अनुज्ञप्ति या अनुज्ञापत्र दिया है, वहां ऐसी अनुज्ञप्ति या अनुज्ञापत्र, उसकी समाप्ति की तारीख तक या ऐसे प्रारंभ से बारह मास की अवधि तक, इनमें से जो भी पूर्वतर हो, विधिमान्य बना रहेगा;
(vi) मनःप्रभावी पदार्थों का विनिर्माण, कब्जा, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, विक्रय, क्रय, उपभोग या उपयोग;
(vii) स्वापक औषधियों और मनःप्रभावी पदार्थों का भारत में आयात और भारत से निर्यात तथा यानान्तरण;
(ख) खण्ड (क) में विनिर्दिष्ट किसी विषय पर केन्द्रीय सरकार का प्रभावी नियंत्रण रखने के लिए अपेक्षित कोई अन्य विषय विहित कर सकेगी;
(2) विशिष्टतया और पूर्वगामी शक्तियों की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियम-
(क) केन्द्रीय सरकार को, समय-समय पर, ऐसी सीमाएं नियत करने के लिए सशक्त कर सकेंगे जिनके अन्दर अफीम पोस्त की खेती के लिए अनुज्ञप्ति दी जा सकेगी;
(ख) यह अपेक्षा कर सकेंगे कि सभी अफीम, ऐसी भूमि के सभी उत्पाद, जिस पर अफीम पोस्त की खेती की गई है, खेतिहरों द्वारा ऐसे अधिकारियों को परिदत्त किए जाएंगे जिन्हें केन्द्रीय सरकार इस निमित्त प्राधिकृत करे;
(ग) अफीम पोस्त की खेती के लिए और अफीम के उत्पादन और विनिर्माण के लिए अनुज्ञप्तियों के प्ररूप और शर्तें, ऐसी फीसें जो उनके लिए प्रभारित की जा सकेंगी, ऐसे प्राधिकरण, जिनके द्वारा ऐसी अनुज्ञप्तियां अनुदत्त, प्रतिधारित, इंकार और रद्द की जा सकेगी और ऐसे प्राधिकरण जिनके समक्ष अनुज्ञप्तियों के प्रतिधारण, इंकार या रद्दकरण के आदेशों के विरुद्ध अपीलें की जा सकेंगी, विहित कर सकेंगे;
(घ) वह विहित कर सकेंगे कि अफीम को उसकी क्वालिटी और गाढ़ेपन के अनुसार ऐसे अधिकारियों द्वारा, जो केन्द्रीय सरकार द्वारा इस निमित्त प्राधिकृत किए जाएं, खेतिहर द्वारा परिदान के समय खेतिहर की उपस्थिति में तोला जाएगा, उसकी परीक्षा की जाएगी और उसका वर्गीकरण किया जाएगा;
(ङ) केन्द्रीय सरकार को सशक्त कर सकेंगे कि वह परिदत्त की गई अफीम के लिए खेतिहर को संदत्त की जाने वाली कीमत समय-समय पर नियत करे;
(च) कारखाने में प्राप्त अफीम का उसकी क्वालिटी और गाढ़ेपन के अनुसार तौल, परीक्षा और वर्गीकरण के लिए तथा ऐसी परीक्षा के परिणाम के अनुसार मानक कीमत में की जाने वाली कटौतियों या परिवर्धनों (यदि कोई हों) के लिए; और ऐसे प्राधिकरणों का, जिनके द्वारा तौल, परीक्षा, वर्गीकरण, कटौतियों, या परिवर्धनों के बारे में विनिश्चय किया जाएगा और ऐसा प्राधिकरणों का, जिनके समक्ष ऐसे विनिश्चय के विरुद्ध अपीलें की जाएंगी, उपबंध कर सकेंगे;
(छ) यह अपेक्षा कर सकेंगे कि किसी खेतिहर द्वारा परिदत्त अफीम यदि केन्द्रीय सरकार के कारखाने की परीक्षा में परिणामस्वरूप अपमिश्रित पाई जाती है तो इस निमित्त प्राधिकृत अधिकारियों द्वारा अधिहृत की जा सकेगी;
(ज) विनिर्मित औषधियों के विनिर्माण के लिए अनुज्ञप्तियों के प्ररूप और शर्तें, ऐसे प्राधिकरण, जिनके द्वारा ऐसी अनुज्ञप्तियां दी जाएंगी और ऐसी फीसें, जो उनके लिए प्रभारित की जा सकेंगी, विहित कर सकेंगे;
(जक) आवश्यक स्वापक औषधियों के विनिर्माण, कब्जे, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, विक्रय, क्रय, उपभोग और उपयोग के लिए अनुज्ञप्तियों या अनुज्ञापत्रों के प्ररूप और शर्तें, ऐसे प्राधिकारी, जिनके द्वारा ऐसी अनुज्ञप्ति या अनुज्ञापत्र दिया जा सकेगा और वह फीस, जो उसके लिए प्रभारित की जा सकेगी, विहित कर सकेंगे;
(झ) मनःप्रभावी पदार्थों के विनिर्माण, कब्जे, परिवहन, अंतर्राज्यिक आयात, अंतर्राज्यिक निर्यात, विक्रय, क्रय, उपभोग या उपयोग के लिए अनुज्ञप्तियों या अनुज्ञापत्रों के प्ररूप और शर्तें, वे प्राधिकरण, जिनके द्वारा ऐसी अनुज्ञप्तियां या अनुज्ञापत्र दिए जा सकेंगे और वे फीसें, जो उनके लिए प्रभारित की जा सकेंगी, विहित कर सकेंगे|
(ञ) ऐसे पत्तन और अन्य स्थान, जिन पर किसी प्रकार की स्वापक औषधियों या मनःप्रभावी पदार्थों का भारत में आयात या भारत से निर्यात या यानांतरण किया जा सकेगा; ऐसे आयात या निर्यात या यानांतरण के लिए, यथास्थिति, प्रमाणपत्र, प्राधिकारों या अनुज्ञापत्रों के प्ररूप और शर्तें, वे प्राधिकरण, जिनके द्वारा ऐसे प्रमाणपत्र, प्राधिकार या अनुज्ञापत्र दिए जा सकेंगे और वे फीस, जो उनके लिए प्रभारित की जा सकेंगी, विहित कर सकेंगे ।
9 NDPS Act in Hindi — Power of Central Government to permit, control and regulate —
(1) Subject to the provisions of section 8, the Central Government may, by rules–
(a) permit and regulate–
(i) the cultivation, or gathering of any portion (such cultivation or gathering being only on account of the Central Government) of coca plant, or the production, possession, sale, purchase, transport, import inter-State, export inter-State, use or consumption of coca leaves;
(ii) the cultivation (such cultivation being only on account of Central Government) of the opium poppy; (धारा 9 एनडीपीएस एक्ट)
(iii) the production and manufacture of opium and production of poppy straw;
1[(iiia) the possession, transport, import inter-State, export inter-State, warehousing, sale, purchase, consumption and use of poppy straw produced from plants from which no juice has been extracted through lancing;]
(iv) the sale of opium and opium derivatives from the Central Government factories for export from India or sale to State Government or to manufacturing chemists;
(v) the manufacture of manufactured drugs (other than prepared opium) but not including manufacture of medicinal opium or any preparation containing any manufactured drug from materials which the maker is lawfully entitled to possess;
1[(va) the manufacture, possession, transport, import inter-State, export inter-State, sale, purchase, consumption and use of essential narcotic drugs:
Provided that where, in respect of an essential narcotic drug, the State Government has granted licence or permit under the provisions of section 10 prior to the commencement of the Narcotic Drugs and Psychotropic Substances (Amendment) Act, 2014 (16 of 2014), such licence or permit shall continue to be valid till the date of its expiry or for a period of twelve months from such commencement, whichever is earlier.] (धारा 9 एनडीपीएस एक्ट)
(vi) the manufacture, possession, transport, import inter-State, export inter-State, sale, purchase, consumption or use of psychotropic substances;
(vii) the import into India and export from India and transhipment of narcotic drugs and psychotropic substances;
(b) prescribe any other matter requisite to render effective the control of the Central Government over any of the matters specified in clause (a).
(2) In particular and without prejudice to the generality of the foregoing power, such rules may (धारा 9 एनडीपीएस एक्ट)
(a) empower the Central Government to fix from time to time the limits within which licences may be given for the cultivation of the opium poppy;
(b) require that all opium, the produce of land cultivated with the opium poppy, shall be delivered by the cultivators to the officers authorised in this behalf by the Central Government; धारा 9 एनडीपीएस एक्ट
(c) prescribe the forms and conditions of licences for cultivation of the opium poppy and for production and manufacture of opium; the fees that may be charged therefor; the authorities by which such licences may be granted, withheld, refused or cancelled and the authorities before which appeals against the orders of withholding, refusal or cancellation of licences shall lie;
(d) prescribe that opium shall be weighed, examined and classified according to its quality and consistence by the officers authorised in this behalf by the Central Government in the presence of the cultivator at the time of delivery by the cultivator;
(e) empower the Central Government to fix from time to time the price to be paid to the cultivators for the opium delivered;
(f) provide for the weighment, examination and classification, according to the quality and consistence, of the opium received at the factory and the deductions from or additions (if any) to the standard price to be made in accordance with the result of such examination; and the authorities by which the decisions with regard to the weighment, examination, classification, deductions or additions shall be made and the authorities before which appeals against such decisions shall lie;
(g) require that opium delivered by a cultivator, if found as a result of examination in the Central Government factory to be adulterated, may be confiscated by the officers authorised in this behalf; धारा 9 एनडीपीएस एक्ट
(h) prescribe the forms and conditions of licences for the manufacture of manufactured drugs, the authorities by which such licences may be granted and the fees that may be charged therefor; (धारा 9 एनडीपीएस एक्ट)
2[(ha) prescribe the forms and conditions of licences or permits for the manufacture, possession, transport, import inter-State, export inter-State, sale, purchase, consumption or use of essential narcotic drugs, the authorities by which such licence or permit may be granted and the fees that may be charged therefor;]
(i) prescribe the forms and conditions of licences or permits for the manufacture, possession, transport, import inter-State, export inter-State, sale, purchase, consumption or use of psychotropic substances, the authorities by which such licences or permits may be granted and the fees that may be charged therefor; धारा 9 एनडीपीएस एक्ट
(j) prescribe the ports and other places at which any kind of narcotic drugs or psychotropic substances may be imported into India or exported from India or transhipped; the forms and conditions of certificates, authorisations or permits, as the case may be, for such import, export or transhipment; the authorities by which such certificates, authorisations or permits may be granted and the fees that may be charged therefor.
