सीआरपीसी की धारा 198B :- अपराध का संज्ञान —
कोई न्यायालय भारतीय दण्ड संहिता (1860 का 45) की धारा 376ख के अधीन दंडनीय किसी अपराध का, जहां व्यक्तियों में वैवाहिक संबंध है, उन तथ्यों को, जिनसे पत्नी द्वारा पति के विरुद्ध परिवाद फाइल किए जाने या किए जाने पर अपराध गठित होता है, प्रथमदृष्टया समाधान होने के सिवाय संज्ञान नहीं करेगा।

No Court shall take cognizance of an offence punishable under section 376B of the Indian Penal Code (45 of 1860) where the persons are in a marital relationship, except upon prima facie satisfaction of the facts which constitute the offence upon a complaint having been filed or made by the wife against the accused husband.
