धारा 17 भ्रष्टाचार निवारण अधिनियम — अन्वेषण के लिए प्राधिकृत व्यक्ति.–
दंड प्रक्रिया संहिता, 1973 (1974 का 2) में किसी बात के होते हुए भी निम्न पंक्ति के नीचे का कोई भी पुलिस अधिकारी–
(क) दिल्ली विशेष पुलिस स्थापना की दशा में पुलिस निरीक्षक|
(ख) बम्बई, कलकत्ता, मद्रास और अहमदाबाद तथा किसी अन्य मेट्रोपोलिटन क्षेत्र में, जैसा कि दंड प्रक्रिया संहिता, 1973 (1974 का 2) की धारा 8 की उपधारा (1) द्वारा अधिसूचना के क्षेत्र में, सहायक पुलिस आयुक्त ।
(ग) अन्यत्र उप-पुलिस अधीक्षक या इसके समकक्ष पद का अधिकारी,
इस अधिनियम के अन्तर्गत दंडनीय किसी अपराध का अन्वेषण यथास्थिति मेट्रोपोलिटन मजिस्ट्रेट, या प्रथम श्रेणी मजिस्ट्रेट के आदेश के बिना अथवा उसके लिए कोई गिरफ्तारी वारंट के बिना नहीं करेगा:
परन्तु यदि पुलिस निरीक्षक की पंक्ति से अनिम्न कोई पुलिस अधिकारी साधारण या विशेष आदेश द्वारा इस निमित्त राज्य सरकार द्वारा प्राधिकृत हो तो वह भी ऐसे किसी अपराध का अन्वेषण, यथास्थिति मेट्रोपोलिटन मजिस्ट्रेट या प्रथम श्रेणी मजिस्ट्रेट के आदेश के बिना अथवा उसके लिए गिरफ्तारी वारंट के बिना कर सकेगा
परन्तु आगे यह भी कि धारा 13 की उपधारा (1) के खंड (ख)] में निर्दिष्ट किसी अपराध का अन्वेषण ऐसे पुलिस अधिकारी के आदेश के बिना नहीं किया जाएगा जो पुलिस अधीक्षक की पंक्ति से अनिम्न हो।
Section 17 prevention of corruption act — Persons authorised to investigate —
Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), no police officer below the rank,–
(a) in the case of the Delhi Special Police Establishment, of an Inspector of Police;
(b) in the metropolitan areas of Bombay, Calcutta, Madras and Ahmedabad and in any other metropolitan area notified as such under sub-section (1) of section 8 of the Code of Criminal Procedure, 1973 (2 of 1974), of an Assistant Commissioner of Police;
(c) elsewhere, of a Deputy Superintendent of Police or a police officer of equivalent rank,
shall investigate any offence punishable under this Act without the order of a Metropolitan Magistrate or a Magistrate of the first class, as the case may be, or make any arrest therefor without a warrant:
Provided that if a police officer not below the rank of an Inspector of Police is authorised by the State Government in this behalf by general or special order, he may also investigate any such offence without the order of a Metropolitan Magistrate or a Magistrate of the first class, as the case may be, or make arrest therefor without a warrant:
Provided further that an offence referred to in 1[clause (b) of sub-section (1)] of section 13 shall not be investigated without the order of a police officer not below the rank of a Superintendent of Police.
