धारा 2 मध्यप्रदेश विशेष न्यायलय अधिनियम — परिभाषाएँ –
(1) इस अधिनियम में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :-
(क) “अधिनियम” से अभिप्रेत है, भ्रष्टाचार निवारण अधिनियम, 1988 (1988 का 49);
(ख) “प्राधिकृत अधिकारी“ से अभिप्रेत है, धारा 14 के प्रयोजन के लिए, उच्च न्यायिक सेवा का कोई सेवारत अधिकारी और जो सेशन न्यायाधीश / अपर सेशन न्यायाधीश हो या रह चुका हो;
(ग) “संहिता” से अभिप्रेत है, दण्ड प्रक्रिया संहिता, 1973 (1974 का 2);
(घ) किसी अपराध के सम्बन्ध में “घोषणा“ से अभिप्रेत है, ऐसे अपराध के सम्बन्ध में धारा 5 के अधीन की गई घोषणा
(ड.)”अपराध” से अभिप्रेत है, आपराधिक अवचार का ऐसा अपराध जो अधिनियम की धारा 13 (1) (ङ) को या तो स्वतंत्र रूप से या अधिनियम के किसी अन्य उपबन्ध या भारतीय दण्ड संहिता, 1860 (1860 का 45) के किसी उपबन्ध के साथ संयुक्त रूप से लागू करने के लिए प्रेरित करता हो;
(च) “विशेष न्यायालय” से अभिप्रेत है, धारा 3 के अधीन स्थापित विशेष न्यायालय ।
(2) उन शब्दों और अभिव्यक्तियों के, जो इसमें प्रयुक्त हुए हों और जो परिभाषित नहीं किए गए हो किन्तु संहिता या अधिनियम में परिभाषित किए गए हो, वे ही अर्थ होंगे जो संहिता या अधिनियम में क्रमशः उनके लिए दिए गए हैं।
Definitions. –
(1) In this Act, unless the context otherwise requires, –
(a) “Act” means the Prevention of Corruption Act, 1988 (49 of 1988);
(b) “authorised officer” means any Serving Officer belonging to Higher Judicial Service and who is or has been Sessions Judge/Additional Sessions Judge, for the purpose of Section 14;
(c) “Code” means the Code of Criminal Procedure, 1973 (2 of 1974);
(d) “declaration” in relation to an offence, means a declaration made under Section 5 in respect of such offence;
(e) “offence” means an offence of criminal misconduct which attracts application of Section 13(1)(e) of the Act either independently or in combination with any other provision of the Act or any of the provision of Indian Penal Code, 1860 (45 of 1860);
(f) “Special Court” means a Special Court established under Section 3;(2) The words and expressions used herein and not defind but defind in the Code or the Act shall have the meanings respectively assigned to them in the Code or the Act.
