*** कोई व्यक्ति जो [किसी [व्यक्ति] को अपनी अभिरक्षा, अपने भाराधीन या देख-रेख में रखते हुए या उस पर प्राधिकार की स्थिति में रहते हुए] उस 4[व्यक्ति] को वेश्यावृत्ति के लिए विलुब्ध किए जाने देगा या उसमें सहायता या उसका दुष्प्रेरणा करेगा, प्रथम [दोषसिद्धि पर, दोनों में से किसी भांति के कारावास से जिसकी अवधि सात वर्ष से अन्यून की होगी किन्तु जो आजीवन के लिए या ऐसी अवधि के लिए जो दस वर्ष तक की हो सकेगी, दण्डनीय होगा और जुर्माने का भी दायी होगा :
परन्तु न्यायालय, पर्याप्त और विशेष कारणों से, जो निर्णय में उल्लिखित किए जाएंगे, सात वर्ष से अन्यून की अवधि के लिए कारावास का दण्डादेश अधिरोपित कर सकेगा ।]
9 Immoral Traffic Act– Seduction of a person in custody.
39,40 *** Any person who 41 having the custody, charge or care of, or a position of authority over, any 39 person, causes or aids or abets the seduction for prostitution of that 39 person, 42 shall be punishable on conviction with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine:
Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than seven years. 43 * * * * *
