अनैतिक व्यापार अधिनियम की धारा 5 – व्यक्ति को वेश्यावृत्ति के लिए उपाप्त करना, उत्प्रेरित करना या ले जाना-
(1) कोई व्यक्ति जो-
(क) किसी 4[व्यक्ति] को चाहे उसकी सम्मति से या उसके बिना वेश्यावृत्ति के प्रयोजनों के लिए उपाप्त करेगा या उपाप्त करने का प्रयत्न करेगा ;
(ख) किसी 4[व्यक्ति] को किसी स्थान से जाने के लिए इस आशय से उत्प्रेरित करेगा कि वह वेश्यावृत्ति के प्रयोजनों के लिए किसी वेश्यागृह का अन्तःवासी हो जाए या उसमें प्रायः जाता रहे ; या
(ग) किसी 4[व्यक्ति] को इस दृष्टि से कि वह वेश्यावृत्ति करे या वेश्यावृत्ति करने के लिए उसका पालन-पोषण किया जाए एक स्थान से दूसरे स्थान को ले जाएगा या ले जाने का प्रयत्न करेगा या लिवाएगा ; या
(घ) किसी 4[व्यक्ति] से वेश्यावृत्ति कराएगा या कराने के लिए उत्प्ररित करेगा,
[दोषसिद्धि पर, तीन वर्ष से अन्यून और सात वर्ष से अनधिक की अवधि के लिए कठोर कारावास से और जुर्माने से भी जो दो हजार रुपए तक का हो सकेगा, दंडनीय होगा और यदि इस उपधारा के अधीन अपराध किसी व्यक्ति की इच्छा के विरुद्ध किया जाता है तो सात वर्ष की अवधि के लिए कारावास का दण्ड चौदह वर्ष की अवधि के लिए कारावास तक का होगा :
परन्तु यदि वह व्यक्ति जिसकी बाबत इस उपधारा के अधीन अपराध किया गया है,-
(i) बालक है तो इस उपधारा में उपबंधित दण्ड सात वर्ष से अन्यून की अवधि के लिए कठोर करने कारावास तक का होगा किन्तु जो आजीवन का हो सकेगा ; और
(ii) अवयस्क है तो इस उपधारा में उपबंधित दण्ड सात वर्ष से अन्यून की अवधि के लिए और चौदह वर्ष से अनधिक की अवधि के लिए कठोर कारावास तक का होगा ;]
(3) इस धारा के अधीन अपराध-
(क) उस स्थान पर विचारणीय होगा जहां से [व्यक्ति] को उपाप्त किया जाता है, जाने के लिए उत्प्रेरित किया जाता है, ले जाया जाता है या लिवा लाया जाता है अथवा जहां से ऐसे 2[व्यक्ति] को उपाप्त करने या ले जाने का प्रयत्न किया जाता है ; या
(ख) उस स्थान पर विचारणीय होगा जहां वह उस उत्प्रेरणा के फलस्वरूप लाया गया हो या जहां वह ले जाया गया हो या लिवा लाया गया हो या उसे ले जाने का प्रयत्न किया गया हो ।
5 Immoral Traffic Act- Procuring, inducing or taking person for the sake of prostitution–
(1) any person who
(a) procures or attempts to procure a 25 person, whether with or without his consent, for the purpose of prostitution; or
(b) induces a 25 person to go from any place, with the intent that he may for the purpose of prostitution become the inmate of, or frequent, a brothel; or
(c) takes or attempts to take a 25 person, or causes a 25 person to be taken, from one place to another with a view to his carrying on, or being brought up to carry on prostitution; or
(d) causes or induces a 25 person to carry on prostitution;
shall be punishable on conviction with rigorous imprisonment for a term of not less than three years and not more than seven years and also with fine which may extend to two thousand rupees and if any offence under this sub-section is committed against the will of any person, the punishment of imprisonment for a term of seven years shall extend to imprisonment for a term of fourteen years: अनैतिक व्यापार अधिनियम की धारा 5
Provided that if the person in respect of whom an offence committed under this sub-section,
(i) is a child, the punishment provided under this sub-section shall extend to rigorous imprisonment for a term of not less than seven years but may extend to life; and
(ii) is a minor, the punishment provided under this sub-section shall extend to rigorous imprisonment for a term of not less than seven years and not more than fourteen years; अनैतिक व्यापार अधिनियम की धारा 5

(3) An offence under this section shall be triable-
(a) in the place from which a 28 person is procured, induced to go, taken or caused to be taken or from which an attempt to procure or take such 28 person is made; or
(b) in the place to which he may have gone as a result of the inducement or to which he is taken or caused to be taken or an attempt to take him is made.
