अनैतिक व्यापार अधिनियम की धारा 6 – किसी व्यक्ति को ऐसे परिसर में निरुद्ध करना जहां वेश्यावृत्ति की जाती है-
(1) कोई व्यक्ति जो [किसी अन्य व्यक्ति] को चाहे उसकी सम्मति से या उसके बिना-
(क) किसी वेश्यागृह में निरुद्ध करेगा, या
(ख) किसी परिसर में या पर इस आशय से निरुद्ध करेगा 3[कि ऐसा व्यक्ति किसी ऐसे व्यक्ति के साथ, जो ऐसे व्यक्ति का पति या पत्नी नहीं है, मैथुन करे, ]
[दोषसिद्धि पर, दोनों में से किसी भांति के कारावास से, जिसकी अवधि सात वर्ष से अन्यून की होगी किन्तु जो आजीवन के लिए या ऐसी अवधि के लिए जो दस वर्ष तक की हो सकेगी, दंडनीय होगा और जुर्माने का भी दायी होगा :
परन्तु न्यायालय, पर्याप्त और विशेष कारणों से, जो निर्णय में उल्लिखित किए जाएंगे, सात वर्ष से कम की अवधि के लिए कारावास का दंडादेश अधिरोपित कर सकेगा ।]
[(2) जहां कोई व्यक्ति किसी वेश्यागृह में किसी बालक के साथ पाया जाता है वहां, जब तक प्रतिकूल साबित न कर दिया जाए, यह उपधारणा की जाएगी कि उसने उपधारा (1) के अधीन कोई अपराध किया है ।
(2क) जहां किसी वेश्यागृह के अन्दर पाए गए किसी बालक या अवयस्क की चिकित्सा परीक्षा पर उसके साथ लैंगिक दुरुपयोग किए जाने का पता चलता है, वहां जब तक तत्प्रतिकूल साबित न कर दिया जाए यह उपधारणा की जाएगी कि उस बालक या अवयस्क को, यथास्थिति, वेश्यावृत्ति के प्रयोजनों के लिए निरुद्ध किया गया है या उसका वाणिज्यक प्रयोजनों के लिए लैंगिक शोषण किया गया है ।]
(3) किसी व्यक्ति के बारे में यह उपधारणा की जाएगी कि वह किसी स्त्री या लड़की को किसी वेश्यागृह में या अपने विधिसम्मत पति से भिन्न किसी आदमी के साथ मैथुन के प्रयोजनों के लिए किसी परिसर में या उस पर निरुद्ध करता है, यदि ऐसा व्यक्ति, उसे वहां रखने के लिए विवश या उत्प्रेरित करने के आशय से-
(क) उसके किसी आभूषण, पहनने के कपड़े, धन या अन्य सम्पत्ति को उससे विधारित करता है, या
(ख) ऐसे व्यक्ति के द्वारा या निदेश से उसे उधार दिए गए या प्रदाय किए गए किसी आभूषण, पहनने के कपड़े, धन या अन्य सम्पत्ति को उसके द्वारा ले जाए जाने की दशा में उसे विधिक कार्यवाहियों की धमकी देता है ।
(4) ऐसी स्त्री या लड़की के खिलाफ उस व्यक्ति के कहने पर जिसके द्वारा वह निरुद्ध की गई है किसी ऐसे आभूषण, पहनने के कपड़े या अन्य सम्पत्ति की वसूली के लिए जो ऐसी स्त्री या लड़की को उधार दी गई या प्रदाय की गई अथवा ऐसी स्त्री या लड़की द्वारा गिरवी रखी गई अभिकथित है अथवा किसी धन की वसूली के लिए जिसका ऐसी स्त्री या लड़की द्वारा संदेय होना अभिकथित है, कोई वाद, अभियोजन या अन्य विधिक कार्यवाही, किसी प्रतिकूल विधि के होते हुए भी, नहीं होगी ।
6 Immoral Traffic Act – Detaining a person in premises where prostitution is carried on.
(1) Any person who detains any other person, whether with or without his consent,
(a) in any brothel, or
(b) in or upon any premises with intent 30 that such person may have sexual intercourse with a person who is not the spouse of such person,
shall be punishable on conviction, with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine:
Provided that the court may, for adequate and special reasons to be mentioned in the judgment, impose a sentence of imprisonment for a term of less than seven years. अनैतिक व्यापार अधिनियम की धारा 6
(2) Where any person is found with a child in a brothel, it shall be presumed, unless the contrary is proved, that he has committed an offence under sub-section (1).
(2A) Where a child or minor found in a brothel, is, on medical examination, detected to have been sexually abused, it shall be presumed, unless the contrary is proved, that the child or minor has been detained for purposes of prostitution or, as the case may be, has been sexually exploited for commercial purposes. अनैतिक व्यापार अधिनियम की धारा 6
(3) A person shall be presumed to detain a woman or girl in a brothel or in or upon any premises for the purpose of sexual intercourse with a man other than her lawful husband, if such person, with intent to compel or induce her to remain there,
(a) withholds from her any jewellery, wearing apparel, money or other property belonging to her, or
(b) threatens her with legal proceedings if she takes away with her any jewellery, wearing apparel, money or other property lent or supplied to her by or by the direction of such person. अनैतिक व्यापार अधिनियम की धारा 6
(4) Notwithstanding any law to the contrary, no suit, prosecution or other legal proceeding shall lie against such woman or girl at the instance of the person by whom she has been detained, for the recovery of any jewellery, wearing apparel or other property alleged to have been lent or supplied to or for such woman or girl or to have been pledged by such woman or girl or for the recovery of any money alleged to be payable by such woman or girl.
