अनैतिक व्यापार अधिनियम 1956 की धारा 4 -वेश्यावृत्ति के उपार्जनों पर जीवन निर्वाह के लिए दण्ड-
(1) अठारह वर्ष की आयु से अधिक का कोई व्यक्ति जो जानबूझकर [किसी अन्य व्यक्ति] की वेश्यावृत्ति के उपार्जनों पर पूर्णतः या भागतः जीवन निर्वाह करेगा, वह कारावास से, जिसकी अवधि दो वर्ष तक की हो सकेगी, या जुर्माने से, जो एक हजार रुपए तक का हो सकेगा, अथवा दोनों से, दण्डनीय होगा [और जहां ऐसे उर्पाजन किसी बालक या अवयस्क की वेश्यावृत्ति से संबंधित हैं, वहां वह सात वर्ष से अन्यून और दस वर्ष से अनधिक की अवधि के लिए कारावास से दण्डनीय होगा] ।
[(2) जहां अठारह वर्ष से अधिक आयु के किसी व्यक्ति की बाबत यह साबित हो जाता है कि वह,-
(क) किसी वेश्या के साथ निवास करता है या अभ्यासतः उसके संग रहता है ; या
(ख) किसी वेश्या की गतिविधियों का ऐसी रीति से नियंत्रण या निदेशन करता है या उन पर असर डालता है जिससे यह दर्शित होता है कि ऐसा व्यक्ति उसे वेश्यावृत्ति करने के लिए सहायता दे रहा है या दुष्प्रेरित या विवश कर रहा है ; या
(ग) किसी वेश्या के निमित्त दलाल या कुटना के रूप में कार्य कर रहा है,
तो, जब तक तत्प्रतिकूल साबित न कर दिया जाए, यह उपधारणा की जाएगी कि ऐसा व्यक्ति उपधारा (1) के अर्थ में अन्य व्यक्ति के वेश्यावृत्ति के उपार्जनों पर जानबूझकर जीवन निर्वाह कर रहा है ।]
Section 4. Punishment for living on the earnings of prostitution-
(1) Any person over the age of eighteen years who knowingly lives, wholly or in part, on the earnings of the prostitution of 22 any other person shall be punishable with imprisonment for a term which may extend to two years, or with fine which may extend to one thousand rupees, or with both 23 and where such earnings relate to the prostitution of a child or a minor, shall be punishable with imprisonment for a term of not less than seven years and not more than ten years.
24 (2) Where any person over the age of eighteen years is proved—
(a) to be living with, or to be habitually in the company of, a prostitute; or
(b) to have exercised control, direction or influence over the movements of a prostitute in such a manner as to show that such person is aiding, abetting or compelling her prostitution; or
(c) to be acting as a tout or pimp on behalf of a prostitute,
it shall be presumed, until the contrary is proved, that such person is knowingly living on the earnings of prostitution of another person within the meaning of sub-section (1).
