अनैतिक व्यापार अधिनियम की धारा 20 – वेश्या का किसी स्थान से हटाया जाना-
(1) कोई मजिस्ट्रेट यह इत्तिला मिलने पर कि उसकी अधिकारिता की स्थानीय सीमाओं के अन्दर किसी स्थान में रहने वाला या प्रायः जाने वाला कोई [व्यक्ति] वेश्या है, प्राप्त इत्तिला का सार अभिलिखित कर सकेगा और ऐसे 1[व्यक्ति] को उससे यह अपेक्षा करते हुए सूचना दे सकेगा कि वह मजिस्ट्रेट के समक्ष हाजिर हो और कारण दर्शित करे कि उससे अपने आप को उस स्थान से हटाने की अपेक्षा और उसमें पुनः प्रवेश करने से प्रतिषिद्ध क्यों न किया जाए ।
(2) उपधारा (1) के अधीन दी गई प्रत्येक सूचना के साथ पूर्वोक्त अभिलेख की एक प्रति होगी और वह प्रति सूचना के साथ उस व्यक्ति पर तामील की जाएगी जिसके खिलाफ सूचना जारी की जाती है ।
(3) मजिस्ट्रेट, उपधारा (2) में निर्दिष्ट सूचना की तामिल के पश्चात्, प्राप्त सूचना की सच्चाई की जांच करने के लिए अग्रसर होगा, और 1[व्यक्ति] को साक्ष्य पेश करने का अवसर देने के पश्चात् ऐसा अतिरिक्त साक्ष्य लेगा जैसा वह ठीक समझता है और यदि ऐसी जांच पर उसे यह प्रतीत होता कि ऐसा 1[व्यक्ति] वेश्या है और साधारण जनता के हित में यह आवश्यक है कि ऐसे 1[व्यक्ति] से अपने आप को वहां से हटा लेने की अपेक्षा की जाए और उसे वहां पुनः प्रवेश करने से प्रतिषिद्ध किया जाए तो मजिस्ट्रेट लिखित आदेश द्वारा, जो उसमें विनिर्दिष्ट रीति से उस 1[व्यक्ति] को संसूचित किया जाएगा, उससे अपेक्षा करेगा कि वह ऐसी तारीख के पश्चात् (जो आदेश में विनिर्दिष्ट होगी) जो आदेश की तारीख से सात दिन से कम की न होगी अपने आप को उस स्थान से ऐसे किसी स्थान को जो चाहे उसकी अधिकारिता की स्थानीय सीमाओं के अन्दर हो या बात ऐसे मार्ग या मार्गों से और ऐसे समय के अन्दर जो आदेश में विनिर्दिष्ट हो हटा ले तथा उसे ऐसे स्थान पर अधिकारिता रखने वाले मजिस्ट्रेट की लिखित अनुज्ञा के बिना उस स्थान में पुनःप्रवेश करने से प्रतिषिद्ध भी कर सकेगा ।
(4) जो कोई-
(क) इस धारा के अधीन दिए गए आदेश का उसमें विनिर्दिष्ट कालावधि के अन्दर पालन करने में असफल होगा या जब किसी स्थान में अनुज्ञा के बिना पुनःप्रवेश करने से उसे प्रतिषिद्धि करने वाला आदेश प्रवृत्त हो तब उस स्थान में ऐसी अनुज्ञा के बिना पुनःप्रवेश करेगा, या
(ख) यह जानते हुए कि किसी 1[व्यक्ति] से इस धारा के अधीन अपेक्षा की गई है कि वह अपने आपको उस स्थान से हटा ले और उसने उसमें पुनःप्रवेश करने की अपेक्षित अनुज्ञा अभिप्राप्त नहीं की है, ऐसे 1[व्यक्ति] को संश्रय उस स्थान में देगा अथवा उसे छुपाएगा,
वह जुर्माने से जो दो सौ रुपए तक का हो सकेगा और जारी रहने वाले अपराध की दशा में अतिरिक्त जुर्माने से जो उस प्रथम दिन के पश्चात् जिसके दौरान वह अपराध करता है प्रत्येक दिन के लिए पच्चीस रुपए तक का हो सकेगा, दण्डनीय होगा ।
20 Immoral Traffic Act – Removal of prostitute from any place –
(1) A magistrate on receiving information that any 70 person residing in or frequenting any place within the local limits of his jurisdiction, is a prostitute, may record the substance of the information received and issue a notice to such 70 person requiring him to appear before the magistrate and show cause why he should not be required to remove himself from the place and be prohibited from re-entering it.
(2) Every notice issued under sub-section (1) shall be accompanied by a copy of the record aforesaid, and the copy shall be served along with the notice on the 70 person against whom the notice is issued.
(3) The magistrate shall, after the service of the notice referred to in sub-section (2), proceed to inquire into the truth of the information received, and after giving the 70 person an opportunity of adducing evidence, take such further evidence as he thinks fit, and if upon such inquiry it appears to him that such 70 person is a prostitute and that it is necessary in the interests of the general public that such 70 person should be required to remove himself therefrom and be prohibited form re-entering the same, the magistrate shall, by order in writing communicated to the 70 person in the manner specified therein, require him after a date (to be specified in the order) which shall not be less than seven days from the date of the order, to remove himself from the place to such place whether within or without the local limits of his jurisdiction, by such route or routes and within such time as may be specified in the order and also prohibit him from re-entering the place without the permission in writing of the magistrate having jurisdiction over such place.

(a) fails to comply with an order issued under this section, within the period specified therein, or whilst an order prohibiting him from re-entering a place without permission is in force, re-enters the place without such permission, or अनैतिक व्यापार अधिनियम की धारा 20
(b) knowing that any 70 person has, under this section, been required to remove himself from the place and has not obtained the requisite permission to re-enter it, harbours or conceals such 70 person in the place, अनैतिक व्यापार अधिनियम की धारा 20
shall be punishable with fine which may extend to two hundred rupees not in the case of a continuing offence with an additional fine which may extend to twenty rupees for every day after the first during which he has persisted in the offence.
