Structure: The Code of Civil Procedure, 1908, is divided into two main parts:

  1. Part I: This part consists of preliminary sections (Section 1 to Section 158) that provide definitions, interpretations, and general principles of jurisdiction and administration.   2. Part II: This part comprises the First Schedule, which includes 51 Orders and Rules. These Orders and Rules detail the specific procedures and methods to be followed in various stages of civil proceedings. They cover a wide range of topics such as institution of suits, pleadings, discovery and inspection, production of documents, summoning of witnesses, examination of witnesses, judgment, execution of decrees, appeals, and more.

The Orders and Rules in Part II are an essential part of the Code as they provide a systematic framework for conducting civil cases in an organized and just manner.

Objectives: The Code of Civil Procedure, 1908, was enacted with several key objectives in mind:

  1. To provide a uniform and consistent procedure for the conduct of civil cases throughout India.
  2. To ensure fairness, justice, and transparency in civil proceedings.
  3. To establish a clear hierarchy of courts and their jurisdictions for different types of civil cases.
  4. To streamline the process of litigation and prevent unnecessary delays and confusion.
  5. To enable parties to effectively present their cases, produce evidence, and seek remedies.

Importance: The Code of Civil Procedure, 1908, is of great significance in the Indian legal system. It governs the process of civil litigation and ensures that disputes are resolved in a timely and just manner.
