Enacted in 1963 by the Parliament of India, the Specific Relief Act is a legislation offering recourse to individuals whose civil or contractual entitlements have been infringed upon. This Act succeeded a previous version from 1877. The subsequent categories of redress can be sanctioned by a court under the tenets of the Specific Relief Act:
- Recovery of possession of property
- Specific performance of contracts
- Rectification of instruments
- Rescission of contracts
- Cancellation of Instruments
- Declaratory decrees
- Injunction
In the inaugural chapter, redress is extended to individuals who have experienced property dispossession. According to the verdict in the case of Nair Services Society vs. K C Alexander [All India Reporter] AIR Year of Judgment-1968 SC [Supreme Court of India] Page No.1165, pursuing a legal action for dispossession against the government is not viable under the provisions of the Specific Relief Act.
